LES CITOYENS DEL'UNION EUROPÉENNE

a)Les citoyens de l'Union résidents ou domiciliésDécret 18.03.1999 du Ministère de la Santé italien

Les citoyens de l'Union ayant la nationalité d'un État membre, résidentsou domiciliés en Italie, sont obligatoirement enregistrés au SystèmeSanitaire National (SSN); ils bénéficient des mêmes conditions queles citoyens italiens résidents.

L�enregistrement auSystème Sanitaire National

L�enregistrement au SSN donne le droit de:

choisir un médecin généraliste et un pédiatre en toute liberté;se soigner auprès d�un spécialiste sur requête du médecingénéraliste ou du pédiatre choisis, en payant le ticket prévu (lespersonnes ayant des pathologies, des invalidités particulières,un certain âge ou sous un déterminé échelon de revenu sontdispensées de payer ledit ticket);bénéficier de l�hospitalisation de jour ou ordinaire à titre gratuit;bénéficier de l�assistance pharmaceutique (achat de médicaments).

LES CITOYENS ÉTRANGERSN'APPARTENANT PAS À L'UNION

a)Les étrangers avec un séjour régulierD. Lgs 286/1998, DPR 394/1999, Circulaire n. 5/2000 Ministère de la Santéitalien, DPR 272/2000

Les citoyens étrangers (résidents ou domiciliés) ainsi que les membresde famille à charge ayant un séjour régulier ont le droit/obligation des�enregistrer au SSN. Ils bénéficient des mêmes prestations et assistancesanitaires réservées aux citoyens italiens. Ils peuvent obtenir le permisde séjour ou le récépissé de renouvellement (délivré par les bureauxde poste locaux) dans les cas suivants:

s�il s�agit de travailleurs non-salariés;s�il s�agit de travailleurs salariés;pour des raisons familiales et de regroupement familial;pour des raisons de formation;pour asile politique;pour des raisons humanitaires;s�ils sont en attente d�asile pour des raisons politiques, humanitaireset religieuses (ils sont exonérés du payement du ticket tout commeles chômeurs enregistrés aux listes de chômage);s�ils sont en attente d�être adoptés;en cas de placement en vue d�adoption plénière;

s�ils sont en attente de nationalité (cette catégorie se compose desétrangers ayant présenté la demande pour obtenir la nationalitéitalienne);traitements médicaux (pour les femmes enceintes ainsi que pourtoute femme pendant six mois après son accouchement).

La demande d�enregistrement doit être présentée aux bureauxd�administration de l�Agence Régionale de Santé de la Vallée d�Aoste.

CAS PARTICULIERS

Il n�est pas obligatoire de s�enregistrer au SSNsi l�on appartient aux catégories suivantes:

titulaire d�un visa d�affaires;titulaires d'un permis de séjour pour raison médicale (exceptionfaite des femmes enceintes)cadre de sociétés ayant leur siège en Italie;salarié de sociétés ayant leur siège à l�étranger;personnes bénéficiant de l�immunité et des privilèges prévus par laConvention de Vienne en matière de relations diplomatiques etconsulaires.

Les personnes faisant partie de ces catégories doivent toutefois avoirune couverture d�assurance pour eux-mêmes et pour les membres deleur famille. Ils ont aussi bien le droit de s�enregistrer volontairementau SSN en payant la contribution prévue.

Décret du Président de la Région n. 68/2006

L�Agence Régionale de l�Accueil appartient au Service de Préfecturede la Présidence de la Région. Cette structure est responsable desprocédés administratifs qui autorisent les citoyens étrangers à l�entréeen Italie pour des raisons de travail et de regroupement familial.Les citoyens étrangers doivent se rendre à l�Agence Régionale del�Accueil dans un délai de 8 jours dès leur entrée en Italie pour remettrele certificat d�attribution du code fiscal, signer le contrat de séjour etdemander le permis de séjour à l�Autorité de Police de province,("Questura")/ Bureau de poste.

Les citoyens étrangers avec un permis de séjour n�excédant pas lestrois mois et, par conséquent, non enregistrés au SSN, peuventbénéficier des prestations offertes par le SSN en payant le tarif totaldu service demandé.Les tarifs sont établis par la Région.

Ces tarifs ne sont pas appliqués aux citoyens étrangers pourvus dedocuments certifiant le droit à l�assistance sanitaire, sur la base de

traités et accords bilatéraux entre l�Italie et les pays suivants:Australie, Argentine, Bosnia-Herzegovina, Brésil, Cité du Vatican,

Croatie, Macédoine, Principauté de Monaco, République de San

Marino, Serbie.

c)Les citoyens étrangers volontairementenregistrés au SSND.Lgs 286/1998, DPR 394/1999, Circulaire n. 5/2000 Ministère de la Santé

L�enregistrement volontaire au SSN peut être demandée par:

les résidents étrangers avec un permis de séjour excédant les troismois qui ne sont pas enregistrés de droit au SSN. L�enregistrements�effectue contre payement en unique solution de 387,34 euros, ilest valable pour une année solaire (de janvier à décembre)et il s�étend aux membres de famille à charge aussi;les séjournants étrangers (non nécessairement résidents) en Italiepour des raisons de formation et ceux travaillant "au pair", mêmes�ils sont titulaires d�un permis de séjour n�excédant pas les troismois. Ces étrangers seront tenus de verser chaque année unecontribution forfaitaire en unique solution pour l�année solaire encours (de janvier à décembre) à titre de participation aux dépensesdu SSN, dans les mesures suivantes:

149,77 euros les séjournants étrangers en Italie pour des raisonsde formation;219,49 euros les étrangers travaillant "au pair".

Cette typologie d�enregistrement volontaire ne peut pas être étendueaux membres de famille à charge. Les étudiants ou les personnestravaillant "au pair" peuvent demander l�enregistrement volontaire auSSN en payant la contribution de 387,34 euros de façon à ce que lesmembres de famille à charge puissent bénéficier de la couverturesanitaire. 12

d)Les citoyens étrangers en situation irrégulièrepar rapport aux règles d'entrée et de séjourD. Lgs 286/1998, DPR 394/1999, Circulaire n. 5/2000 Ministère de la Santé

Les citoyens étrangers en situation irrégulière par rapport aux règlesd�entrée et de séjour, dépourvus de moyens d�existence suffisants, ontle droit de bénéficier de l�assistance sanitaire en présentant une cartede santé spécifique. Cette carte est caractérisée par le code STP("Straniero Temporaneamente Presente", c�est-à-dire "Étrangerprésent à titre temporaire"), elle est valable six mois sur tout leterritoire national et elle peut être renouvelée si le séjour se prolonge.

Le code STP est délivré uniquement par le Centre d�accueil pourla santé des immigrés (S.I.S.I. � Sportello Informativo per laSalute degli Immigrati), créé par l�Agence Régionale de Santéde la Vallée d�Aoste. Le SISI est situé à Aosta, via Guido Rey, 1 (aurez-de-chaussée). Il est ouvert de lundi à vendredi à l�horaire suivant:8.00h-13.00h/14.00h-16.00h (tel. 0165.544418/544688).

Les citoyens étrangers dépourvus de moyens d�existence suffisantspeuvent demander une déclaration d�indigence en remplissant unformulaire spécifique du Ministère de la Santé. Par cette déclarationles citoyens étrangers sont dispensés de payer le ticket des prestations.Le code STP ainsi que la déclaration d�indigence peuvent être concédésmême si les étrangers ne disposent pas de papiers d�identité.Les données personnelles enregistrées au SISI sont protégéesaux sens de la législation en vigueur. 13

Tout comme pour les citoyens italiens, les professionnels de la santéne doivent pas signaler les étrangers qu�ils soignent, sauf s'ils sontobligés de rédiger le rapport médical (par ex. hospitalisation au servicedes urgences à cause de blessures d�armes à feu, de lésions graves etc�).

Les citoyens étrangers en situation irrégulière par rapport aux règles d�entrée

et de séjour peuvent s�adresser aux structures publiques ou agrées. Ici ils peuvent

bénéficier des traitements ambulatoires et hospitaliers urgents, ou de toute façon

essentiels et continus, provoqués par une maladie ou un accident. Par ailleurs

ils ont le droit de participer aux programmes de médecine préventive qui

préservent la santé individuelle et collective (art. 35 D.Lgs 286/98).

Le Ministère de la Santé précise que:

les traitements urgents sont ceux qu�il n�est paspossible différer, car tout retard mettrait en dangerla vie et la santé de la personne;

les traitements essentiels sont des prestations sanitaires,diagnostiques et thérapeutiques pour des pathologies qui ne sont pasdangereuses dans l�immédiat ou à court terme, mais qui pourraientêtre préjudiciables à la santé ou à la vie de la personne à plus longterme (par ex. complications, aggravation, chronicisations).

La loi garantit le principe de continuité des traitements urgents etessentiels, c�est-à-dire qu�elle assure des cycles complets de thérapieet de rééducation pour la guérison de la maladie. 14

En particulier le SSN garantit un service gratuit pour:le suivi médical des mineurs;les prestations liées à la grossesse et à l�accouchement (égalité detraitement avec les citoyennes italiennes);les mesures prises dans le cadre de campagnes internationales deprévention;la prévention, le diagnostic et le traitement de maladies infectiueses;les vaccinations obligatoires;la prévention, le traitement et la rééducation de la toxicodépendance.

Ce service ne s�applique pas aux citoyens étrangers enregistrés au SSN,qui doivent payer le ticket correspondant à la prestation reçue.

ATTENTION Les citoyens étrangers ayant la carte STP ne sont pas enregistrés au SSN; ils ne peuvent donc choisir ni un médecin généraliste ni un pédiatre. Ils peuvent toutefoiss�adresser au Dispensaire pour les étrangers auprès du SISIpour les prestations essentielles (première visite médicale,prescriptions d�analyses et examens, visites chez un spécialiste etmédicaments). Le Dispensaire est situé à Aosta, via Guido Rey, 1 (au rez-de-chaussée); il est ouvert le mercredi de 15.00h à 17.00h.

ENTRÉE ET SÉJOUR POURRAISON MÉDICALE

a)Séjour pour raison médicaleD. Lgs 286/98, Circulaire n. 5/2000 Ministère de la Santé italien

Les citoyens étrangers qui ont l�intention de recevoir des traitementsmédicaux en Italie ne peuvent pas être enregistrés au SSN. Ils doiventdonc effectuer le payement correspondant aux traitements reçus.Ils doivent demander, pour eux et pour d�éventuels accompagnateurs,le visa d�entrée ainsi que le permis de séjour délivrés par l�Ambassadeitalienne ou par le Consulat compétent, en présentant la documentationsuivante:

déclaration rédigée par la structure italienne choisie, indiquant letype de traitement, sa date de début et sa durée supposée;certification du versement d�une somme en caution au bénéfice dela structure choisie. Cette somme, versée en Euros ou en Dollarsaméricains, doit représenter le 30% du coût total supposé desprestations;documents prouvant d'avoir en Italie les ressources suffisantes pourcouvrir les frais sanitaires, de nourriture, de logement (hors de lastructure sanitaire) et de rapatriement de l�assisté ainsi que de sonaccompagnateur.

Dans ce cas le permis de séjour est valable pour la durée supposée dutraitement et peut être renouvelé jusque les besoins thérapeutiquesdocumentés subsistent.

b)Déplacement en Italie dans le cadre d'urgenceshumanitaires D. Lgs 517/1993, Loi 449/1997, Circulaire n.5/2000 Ministère Santé italien,DPR 334/2004

Programmes d�urgences humanitaires du Ministère de laSanté italienLe Ministère de la Santé, en collaboration avec le Ministère des Affairesétrangères, a le droit d�autoriser, pour des raisons médicales, ledéplacement des étrangers résidents dans des pays dépourvus destructures sanitaires appropriées et adéquates.

Programmes d�urgences humanitaires des RégionsLes Régions ont le droit d�autoriser des prestations de hautespécialisation dans le cadre de programmes d�assistance, en accordavec le Ministère de la Santé, l�Agence Régionale de Santé et lesstructures hospitalières. Ces prestations sont destinées:

aux ressortissants de pays extra-communautaires, où il n�existe oune sont pas facilement accessibles des compétences spécialiséespour le traitement de pathologies graves. Dans ce cas, entre l�Italieet ces pays, des accords de réciprocité en matière d�assistancesanitaire ne doivent pas être en vigueur;aux ressortissants de pays qu�à présent, pour desraisons politiques, militaires ou d�autre type, nesont pas en mesure de mettre en place des accordsexistants avec le SSN.

EXEMPTION POUR PATHOLOGIE,INVALIDITÉ, ÀGE, REVENU

Les citoyens étrangers enregistrés au SSN et titulaires d�un permis deséjour excédant une année ou d�une carte de séjour, peuvent présenterla demande d�exemption pour pathologie, invalidité civile, âge et revenuà l�Agence Régionale de Santé. La concession gratuite de prothèsesn�est possible qu�en présence de cette qualité.Le procédé administratif est le même prévu pour les citoyens italiens.Pour toute information s�adresser aux bureaux d�administration desDomaines socio-sanitaires ou au Bureau Invalides (siège AgenceRégionale de Santé, Via Guido Rey, 1 � Aosta tel. 0165.544439 �horaires: lundi, mercredi, jeudi, vendredi de 8.00h à 13.30h/mardi de8.00h à 16.00h).

ENTRÉE ET SÉJOURPOUR DES RAISONS TOURISTIQUES

Les citoyens italiens titulaires de visas touristiques ne peuvent pass�enregistrer, même de façon volontaire, au SSN. Ils doivent stipulerune police d�assurance spécifique dans le pays d�origine.Si les citoyens étrangers sont dépourvus de police d�assurance,ils seront tenus de payer entièrement le tarif correspondantà la prestation reçue.

Tous les détenus étrangers (réguliers et irréguliers), y compris ceux ensemi-liberté ou soumis à des mesures alternatives de la peine, sontenregistrés au SSN et les prestations sont effectuées par l�AgenceRégionale de Santé.Les détenus reçoivent le même traitement et ont les mêmes droitsque les citoyens libres. Ils sont par ailleurs exonérés du payement duticket.

L�Agence Régionale de Santé assure en particulier:prévention, soin et soutien au malaise psychologique et social;assistance en cas de grossesse et d �accouchement;assistance pédiatrique pour les enfants des détenues;assistance aux toxico-dépendants;

DISPENSAIRE MÉDICAL POUR LESÉTRANGERS

Qu'est-ce le SISI ?C�est un centre créé par l�Agence Régionale de Santé de la Valléed�Aoste en 2000 pour fournir toute information en matière sanitaireaux citoyens étrangers présents dans la région.

Qui peut accéder au SISI ?Les ressortissants de pays membres de l�Union Européenne.Les ressortissants de pays extra-communautaires ayant un permisde séjour régulier.Les ressortissants de pays extra-communautaires en situationirrégulière par rapport aux règles d�entrée et de séjour.

Quels sont les devoirs du SISI ?Fournir toute information nécessaire en matière sanitaire.Délivrer les codes STP (Straniero Temporaneamente Presente,c�est-à-dire "Étranger présent à titre temporaire") et les éventuellesdéclarations d�indigence (si les étrangers sont dépourvus de moyensd�existence suffisants). Le SISI est le seul centre de repèrerégional qui délivre les codes STP.

LE DISPENSAIRE MÉDICAL POUR LES ÉTRANGERSLes citoyens étrangers ayant la carte STP ne sont pas enregistrés auSSN; par conséquent ils ne peuvent choisir ni un médecin généralisteni un pédiatre.Pour cette raison, en 2000, l�Agence Régionale de Santé de la Valléed�Aoste a créé un dispensaire spécifique destiné aux étrangers qui sonten situation irrégulière par rapport aux règles d�entrée et de séjour.Le médecin présent audispensaire fournit auxétrangers ayant la carteSTP les prestationsessentielles, c�est-à-dire:

première visite médicale;prescriptions d�analyses et examens; visites chez un spécialiste; prescriptions de médicaments qu�on peut acheter dans toutes les pharmacies de la Région.

Le dispensaire pour lesétrangers est situé à côté duSISI (via Guido Rey, 1 � rez-de-chaussée). Il est ouvert tous lemercredi de 15 h. à 17.00 h.

L'INTERPRÈTE EN MILIEU SOCIAL

Qui est l'interprète en milieu social ?L�interprète en milieu social est un professionnel social, qui facilite lacommunication et représente un point de repère pour les étrangers,les services et les institutions. En général il s�agit d�un étranger immigréqui connaît bien l�italien ainsi que sa langue maternelle et qui exercedes compétences socio-éducatives. En particulier:

il/elle oriente les étrangers à l�utilisation des services et représenteun trait d�union entre service et usager;il/elle facilite la communication entre étrangers et services, entreitaliens et étrangers;il/elle informe et sensibilise les étrangers aux diversités culturelles,à la culture locale et aux règles des services;il/elle interprète et fournit une médiation linguistique;il/elle contribue à interpréter, de façon correcte, des comportementsprovoqués par des facteurs culturels.

L'interpète à l'HôpitalLe service d�interprétariat en milieu social est présent dans les structureshospitalières de Beauregard (à partir de l�année 2003 auprès des servicesd�Obstétrique et de Gynécologie) et de Viale Ginevra (à partir del�année 2006). Le service d�interprétariat en milieu social a les suivantsbuts à l�égard de ses usagers:

il crée les conditions à ce que les patients puissent exprimer leursbesoins, questions, doutes et comprendre le fonctionnement del�hôpital; 22

il augmente la connaissance et l�utilisation des services.

L'interprète, quand est-il présent ?L�interprète est présent dans les deux structures hospitalières tous lesmatins du lundi au vendredi. Au délà de cet horaire il ne pourra êtrecontacté que pour des urgences. L�interprète peut être utilisé auprèsde tous les services de l�hôpital.

Quelle est son activité principale ?au guichet, i l /elle oriente et informe les étrangers;il/elle effectue des médiations linguistiques et culturelles auprès del�hôpital et des services sur requête des professionnels;il/elle contribue à la communication interculturelle et à la formationà travers:

- l�indication de problèmes;- la préparation d�outils informatifs en langue;- l�élaboration de parcours formatifs pour les professionnels.

L'interprète dans les domaines socio-sanitairesLes interprètes en milieu social sont présents dans lesdomaines socio-sanitaires aussi, où ils exercent plus oumoins les mêmes tâches qu�à l�hôpital.En particulier ils sont présents auprès des sièges suivants:

Enparticulier les initiatives liées à l�institution du SISI, au dispensairemédical pour les étrangers et au service d�interprétariat en milieu socialfont partie du projet WHO-OMS "Migrant Friendly Hospitals �Hôpital et Interculturalité".

CITIZENS BELONGING TO THEEUROPEAN UNION

a)EU Citizens legally residing or dwelling in ItalyDecreto 18.03.1999 of the italian Ministry of Health

EU citizens, nationals of any EU Member State, legally residing ordwelling in Italy are compulsorily enroled with the Italian NationalHealth Care Service (Servizio Sanitario Nazionale � SSN) as Italiannationals in Italy are, without any distinction of the treatment provided.

Italian Health Care National Service(SSN) Enrolement

People who enrol with the Italian SSN retain the right:

to choose freely a physician (family doctor) and a paediatricianto receive specialized medical treatment upon request of thephysician or the paediatrician chosen, by paying an healthcharge fixed by the Italian government which is referred to as�ticket� (People with specific diseases or disabilities, under orover a given age and whose incomes don�t exceed a givenamount are exempted from paying such ticket.)to be admissed in public and accreditated hospitals as well asto be treated in day-hospital for freeto get pharmaceutical assistance (purchasing of medical drugs)

Foreign citizens legally residing or dwelling in Italy and holding avalid Permit of Stay or having applied for its renewal (issued by localpost office), retain the right to/ are obliged to enrol with the ItalianNational Health Care Service. Once they are enroled with the ItalianSSN, they can benefit by health care provided by the Italian SSN, asany Italian citizen is entitled to. Moreover, all their family membersbeing under their care and legally living in Italy, retain thesame right. Foreign citizens mayobtain the Permit of Stay or its renewal in the following circumstances:

if they are self-employedif they are employedfor family reasons and family reunificationfor studying purposesfor political asylumfor humanitarian reasonsif they are claiming for asylum because of political, humanitarianand religious reasons (They are exempted from paying �tickets� asunemployed people enroled with unemployment lists.)if they are waiting for being adoptedif they are waiting for being fostered

PARTICULAR CASES

Enrolment with the Italian SSN is not compulsoryfor foreigner citizens belonging to the following categories:

holders of Permit of Stay for business reasonsholders of a Permit of Stay for health care treatment (pregnantwomen excepted)managers of a company having its head office in Italypeople being in the employ of a company which has its head officeabroadpeople granted for immunity and privileges set down by the ViennaConvention on Diplomatic and Consular Relations.

However, it is suitable that such foreign citizens insure themselvesas well as all their family members. Foreign citizens can alsovoluntarily enrol with the Italian SSN by paying a year�s health charge.

The Help Desk for Immigrants belongs to the Regional Presidencyof Aosta Valley. It is a structure charged with administrative proceduresaimed at licensing permits of entry to Italy for foreign citizens accordingto employment reasons or family reunification. In order to sign acertification attesting his/her stay in Italy (�Contratto di Soggiorno�)and to apply for the Permit of Stay at the �Questura� (Provincial PoliceAuthority) or "Uffici Postali" (local post offices) , any foreign citizenhas to deliver a certification attesting his/her tax identification number(�codice fiscale�) to the Help Desk for Immigrants.

Foreigners holding a Permit of Stay expiring within three months -so who are not enroled with the Italian SSN - are granted to receivehealth care provided by the Italian SSN in return for full paymentof the existing health charges.Health charges are fixed by Italian Regions.

Foreigners who may be exempted from paying such health chargeshave to own special documents allowing them to receive health

care in compliance with treaties and bilateral agreementssigned by Italy and the following countries:

Australia, Argentina, Bosnia & Herzegovina, Brazil,

Vatican City, Croatia, Macedonia, Monaco, San

Marino, Serbia.

c) Foreigners voluntarily enroling with the Italian National Health Care Service (SSN)D.Lgs 286/1998, DPR 394/1999, Circular n. 5/2000 of the Italian Health Ministry

Voluntary enrolement with the Italian SSN can be subscribed :by foreigners residing in Italy and holding a Permit of Stay for aperiod of more than 3 months but not falling within foreignerscategories being entitled to enrol with the Italian SSN. They haveto pay a single year�s health charge of 387,34 Euros, sinceenrolment starts on the 1st of January and it expires on the31st of December of each year. Enrolment may also be extendedto foreigners dependants.by foreigners dwelling in Italy for studying purposes (but notnecessarily residing there) and by foreigners with an �au pair� statusdespite they hold a Permit of Stay expiring before 3 months.As a contribution to health charges, such foreigners have to pay asingle year�s forfait (�year�s� being understood as referred to a calendaryear, so going from the 1st of January to the 31st of December), asfollows :

149,77 Euros have to be paid by foreigners dwelling in Italyfor studying purposes;219,49 Euros have to be paid by foreigners with an "au pair"status.

Such voluntary enrolment cannot be extended to their dependants.Any student or any �au pair� foreigner having family members underhis/her care may apply for voluntary enrolment in return for thepayment of 387,34 Euros in order to insurance his/her dependants.

d)Foreigners illegally entering or dwelling inItalyD.Lgs 286/1998, DPR 394/1999, Circular n. 5/2000 of the Italian Health Ministry

Foreigners illegally entering or dwelling in Italy and lacking of economicmeans are granted with health care through the S.T.P. card(�Stranieri Temporaneamente Presenti� - ForeignersProvisionally Staying in Italy).The S.T.P. card expires within six months, it is renewable in the eventof a longer stay in Italy and it is valid throughout the country.

In Aosta Valley, the Help Desk for Immigrants Health Care(S.I.S.I. - �Sportello Informativo per la Salute degli Immigrati�) �created by the Regional Health Agency of Aosta Valley � is theonly reference centre charged with issuing S.T.P. cards.The S.I.S.I. is located in Aosta, via Guido Rey, 1 (ground floor). It isopen from Monday to Friday, from 8 to 13 and from 14 to 16 (tel.0165.544418 / 544688).

Any foreigner lacking of economic means may request a specialdocument attesting his/her want living conditions by filling theform provided by the Italian Ministry of Health. Thanks to suchdocument he/she is exempted from paying charges related to healthcare services (�ticket�). The S.T.P. card as well as the �dichiarazionedi indigenza� may be licensed even without presenting the identitycard or any other kind of identity document. All personal data recordedby the S.I.S.I. are protected in compliance with the Italian PersonalData Protection Norms. 35

As for Italian nationals, exploitation of Italian health care facilitiesby foreigners should not be notified to Police Authorities but in theevent that medical report is compulsory (e.g. admission in First Aid- �Pronto Soccorso� - because of serious injuries connected withcriminal offence, such as having been shot, etc.).

Urgent and necessary treatment in outpatients� departements as well

as in public and accreditated hospitals, even on continued basis,

because of diseases or accidents, are guaranteed to all foreigners

illegally entering or dwelling in Italy. Such foreigners also benefit

by preventive medical treatment programmes aimed at safeguarding

individual and collective health (art. 35 D.Lgs 286/98).

Urgent treatment: it refers to alltreatments which cannot be put offto a late time in order to safeguardpatient�s health or life.

Essential treatment: it refers to health care, diagnosis and medicaltreatments related to diseases not immediately or short-termendangering patient�s life but which could long-term endager patient�shealth or life (e.g. late complications, worsening of the disease, chronicdisorders).

The Italian law sets down that urgent and necessary treatmentmust be given on continued basis (�principio di continuità�) inorder to make any patient be assured to full treatment or rehabilitationin connection with patient�s healing process.

Except for people enroled with the Italian SSN who have to pay fixedhealth charges (�ticket�), the Italian SSN provides health care for freein connection with any treatment aimed at:

minors� health safeguardsafeguard of pregnancy and maternity in order to guarantee equalityof health care treatment provided to Italian female citizensinternational prophylaxispreventive treatment, diagnosis and treatment of infectious diseasesall vaccinationsprevention, treatment and rehabilitation of drug addicts.

PLEASE NOTE Since foreigners holding the S.T.P. card cannot enrol with the Italian SSN, they cannot benefit by a physician or a paediatrician of their free choice. In order to benefit by primary sector care (medical examination, prescriptions for clinical testsand check-ups, prescriptions for specialized medical examination andfor purchasing medical drugs) they have to go to the Outpatients�Department for Foreigners (�AmbulatorioStranieri�) at the S.I.S.I..The Outpatients� Department for Foreigners is located in Aosta, via Guido Rey, 1 (ground floor). It is open on Wednesdays from 3 to 5 p.m.

ENTRY TO AND STAY IN ITALY FORHEALTH CARE REASONS

a) Stay in Italy for health care reasonsD.Lgs 286/98, Circular n. 5/2000 of the Italian Health Ministry

Any foreign citizen travelling to Italy to receive health care treatmentcannot be enroled with the Italian SSN. So he/she has to pay fullhealth charges related to the treatment provided.He/she has to apply for entry visa and Permit of Stay - both forhimself/herself and for anyone who travels with him/her - at ItalianEmbassies and Consulates. In order to obtain such documents, he/shehas:

to disclose what Italian health care facility he/she choosed, whatkind of medical treatment he/she needs as well as when suchtreatment is supposed to begin and when it is supposed to finish;to pay 30% of the total health charges in compliance with theservices provided to the chosen Italian health care facility and toattest that such caution money deposit occurred through a specificcertification (such payment can be done in Euros or U.S. Dollars);to certify that he/she has sufficient economic means to provisionallystay in Italy, namely that he/she is able to pay full health charges,all costs related to board and lodging outside the health care facilityas well as all costs related to his/her repatriation. Any foreign patientas well as anyone who travels with him/her shall satisfy the abovecondition.In such circumstances the Permit of Stay expires when the medicaltreatment needed is supposed to finish. However, it is renewableuntil the foreign patient needs further health care. Reasons forfurther medical treatment have to be certified. 38

b) Transfer to Italy for humanitarian reasonsD.Lgs 517/1993, Law 449/1997, Circular n. 5/2000 Ministry of Health, DPR 334/2004

Italian Ministry of Health humanitarian programmesThe Italian Ministry of Health, together with the Italian Ministry ofForeign Affairs, may allow foreign citizens to be transferred to Italyin order to be given health care treatment because their own countrieslack of proper and suitable health care facilities.

Regional humanitarian programmesTogether with the Italian Ministry of Health, the Italian Regions mayallow local health agencies (A.S.L. - Azienda Saniataria Locale) andhospitals to provide highly specialized services being part of healthcare programmes directed to :

citizens coming from non-EU countries where it is hard to findspecialized health care expertise concerning medical treatment ofserious diseases or where such expertise lacks as well as wheremutual health care agreements are not in force;citizens coming from any country where existing health careagreements with the Italian SSN cannot be implementedbecause of political, military or any other reasons.

EXEMPTION FROM HEALTH CHARGES ACCORDING TOSPECIFICA DISEASES, INVALIDITY, AGE, INCOME

D.lgs 286/1998

Foreigners holding a Stay Permit for a period of no less than a year(or a permit attesting their effective place of residence) and being dulyenroled with the Italian SSN may apply for exemption from healthcharges according to specific diseases, invalidity, age and income atthe local health agencies (A.S.L. - Azienda Sanitaria Locale). Freesupply of prosthesis by the Italian SSN shall be subject to the sameobligation.Foreign citizens have to tackle with the same administrative proceduresexisting for Italian nationals.For further information, please contact Districts administrative officesor the Invalidity Office (�Ufficio Invalidi�), the latter being locatedwithin the Regional Health Agency of Aosta Valley head office (AziendaU.S.L. Foreign citizens holding an entry visa for touristic purposes are notallowed to enrol with the Italian SSN (even as far as voluntary enrolmentis concerned).

It is suitable that foreign tourists subscribe an insurance policy intheir own country of origin.In the event that they lack of such insurance policy, they willhave to pay full health charges in return for the health careservices received.

HEALTH CARE TO FOREIGN PRISONERSD.lgs 230/99

All foreign legal and illegal prisoners, all foreign prisoners held in�open� conditions as well as all foreign prisoners to whom any otherkind of punishment is imposed are enroled with the Italian SSN. Itis up to local health agencies (A.S.L. - Azienda Sanitaria Locale) toprovide health care services to such foreigners who are granted tobenefit by health care as any other free citizen, without any kind ofdistinction.Foreign prisoners are exempted from paying health charges (�ticket�).

Paritcularly, local health agencies (A.S.L.) provide the following freeof charge services:

prevention, treatment and support forpsychiatric and social disorderssupport for pregnancy and maternitypaediatric health care for children offoreign female prisonerssupport for drug addicts.

What is the Help Desk for Immigrants Health - SISI ?It is an help desk intentionally set up by the Regional Health Agencyof Aosta Valley (Azienda U.S.L. Valle d�Aosta) in 2000, in order toprovide health care information to foreigners staying in the AostaValley.

Who can use the services proveded by the SISI ?Citizens coming from European Union Member StatesNon-EU foreign citizens holding a valid Permit of StayNon-EU foreign citizens illegally entering or dwelling in Italy/AostaValley.

What does the SISI provide ?It provides full health care information.It issues S.T.P. cards (Straniero Temporaneamente Presente �Foreigner Provisionally Staying in Italy) and special documents(such as the so-called �dichiarazione di indigenza� in the event thatforeigners lack of ecomonic means). The S.I.S.I. is the onlyregional body allowed to release S.T.P. cards.

OUTPATIENTS' DEPARTEMENT FOR FOREIGNERSSince foreigners holding S.T.P. cards cannot enrol with the ItalianSSN, they cannot benefit by a physician or a paediatrician of theirfree choice. So in 2000 the Regional Health Agency of Aosta Valleycreated a specific outpatients� department aimed at helping anyforeigners illegally residing or dwelling in Italy/Aosta Valley.The outpatients� departmentphysician provides primary sectorcare to all foreigners holding S.T.P.cards, such as:

medical examinationprescriptions for clinical testsand check-upsprescriptions for specialized medical

examinationsprescriptions for medical drugs(medical drugs being purchasedin any pharmaceutics acrossAosta Valley).

The Outpatients� Departmentfor Foreigners is located nearthe S.I.S.I. (Aosta, via GuidoRey, 1 � ground floor). It is openon Wednesdays from 3.00 to5.00 p.m.

THE "MEDIATORE INTERCULTURALE"

Who is the "Mediatore Interculturale" ?The �Mediatore Interculturale� is a cultural mediator who acts as asocial professional. It makes intercultural communication moreunderstandable and it is a point of reference for foreigners and localinstitutions. Generally he/she is a foreign immigrant with a goodknowledge of Italian language as well as of his/her own language.He/she shows also a social and educational expertise. Particularly:

he/she advises foreigners on how to use local services and he/sheacts as a mediator between professionals and users;he/she makes communication more understandable between foreignusers and local professionals, so as between Italian nationals andforeigner citizens;he/she makes foreigners fully aware of cultural diversity and localculture and he/she advises them on how duly using local services;he/she provides linguistic mediation, translation and interpretation;he/she helps providing a correct interpretation of social behavioursdepending on cultural factors.

The "Mediatore Interculturale" working in hospitalIn compliance with an agreement signed by the Cooperativa Sociale�La Sorgente� of Aosta and the Regional Health Agency of AostaValley, the �Mediatore Interculturale� provides his/her serviceswithin the �Beauregard Hospital� - in the Obstetrics andGynaecology Departments - since 2003 as well as within the hospitallocated in viale Ginevra since 2006.

Towardst foreign users, the cultural mediation service aims at:making foreign patients be able to express their needs, requestsand questions as well as to clearly understand what happens to themas they are hospitalised;making foreign users fully aware of how to use health care servicesprovided.

When does the "Mediatore Interculturale" work ?The �Mediatore Interculturale� works in the two hospitals in themorning, from Monday to Friday. He/she may also be contacted forurgent and serious cases only at any time. He/she may provide his/herservices in all hospital departments.

What are his/her main tasks ?He/she works at help desks, especially as far as advisory and supportservices for foreign users are concerned;he/she provides linguistic and cultural mediation in hospitaldepartments and for any local professional requesting his/herintervention;he/she makes intercultural communication more understandableand improves training. He/she points out and reports about foreignusers issues; he/she provides written information in foreign language;he/she helps creating specific training courses directed to healthcare professionals.
