spoke to me in icfercnce tothe purchase of sonic liquors fromMacfarlanc & Co. at the lequcst ofthe King, and referred to obtaining'certain orders from the King. Cus-tom House orders, orders on theCustom House for liquors. Mr.Hayseldcn said, as near as I canremember, that the object was toobtain these liquors from the Cus-tom House without the payment ofduties, to replace goods from Mac-farlanc & Co. I think he said thathe was somewhat responsible forthose liquors. Perhaps these werenot his exact words. I don't re-

member that he said anything aboutbeing urged in this matter. 1 recol-lect testifying in the preliminary ex-

amination. I might have testifiedthat Macfarlane & Co. was pressingHayseldcn for an account. Thetestimony I then gave was true. Idon't know whether Mr. Hayseldcnreceived any orders at this time. 1

don't remember having testified atthe other examination that he did.After having his memory refreshedhe said, I did testify so. I knew hegot some orders, but don't knowwhat for.

Cross examined : I can't say whatthe exact words were of Mr. Haysel-dcn when he came for the orders.He said to the effect that he wantedorders for goods from the CustomHouse without the payment of duties. There was no necessity forany explanation, as I knew what homeant.

Chief Justice Judd, sworn : I amChief Justice of the Supreme Court.I held a preliminary examination ofthe defendant for conspiracy. Iheard all the evidence and recordedit myself. The defendant wassworn as a witness in his own be-half on the 15th of March this year.It is my custom to record evidencein important cases. Here the coun-sel for defence admitted that Mr.Macfarlane pressed Hayseldcn for asettlement and threatened a suit.Mr. Macfarlane testified twice in re-

gard to this matter. The witnessstated that he pressed Hayseldcnand threatened suit. Hayseldcnsaid that he would get an order.Hayseldcn was procrastinating andmy brother Henry was vexed. Itwas the Ilaysclilen acount which wasreferred to.

Mr. Reist was then called andsworn : I am second deputy clerk ofthe Supremo Court. I held thatposition during March. 1 recollectthe examination of tho defendant onthe charge of Conspiracy. 1 waspresent at tho examination. I tooknotes of evidence. The defendantwas a witness in his own behalf. Theoath was administered by myself. 1

amination: I don't know about hisordering or the delivery. Ilnybel-de- n

was procrastinating and Henrywas annoyed, and said to me I willget a settlement. I was in Englandat the time of settlement. Ordersfrom tho King and Hayseldcn werebeing filled and I did not object toit. During 188C had an accountwith the King. Used to look overtho trial balance. It is not the ruleto allow an account to run into thenext quarter. Saw the King comein personally and order liquors onthe Hayseldcn account. Don't knowif all jh entered to Ilnyselden'a ac-

count. Spoke to Hayseldcn inAugust about settlement of account,I understood ho brought in an orderafterwards.

being sworn, testified! 1 was in Ho-

nolulu during 1880. I was in thofirm of G. W. Macfarlane & Co. asManaging Clerk. 1 Mas there dur-ing the timo the liquors in questionwere sold. Tho first I know of it,was the delivery of the Honors.Thoy were ordered by Hayseldcnand tho King, also Knpena, Kcattand Lilikalani. I think thoy werethe principal ones ordering. Abouttuo-tuir- of the amount was order-ed by the King in person, and bywritten orders.

The Crown objected to the evi-

dence as to the written orders of theKing unless the orders were pro-duced.

The Court allowed the evidence.I had conversation with the King

in regard to this matter. 1 saw thedelivery of these goods being made,and received orders personally fromthe King. The goods were sent allover the islands. Some of thegoods went to luaus before and afterthe elections. After the deliverywas made, I had a conversation withthe King at the palace, and he saidhe wanted a separate account ofthis, nnd Mr. Hayseldcn would goover it and sec if it was correct.The account was consequently keptin the back of the blotter. I hadinstructions from the King to deliverto certain parties. I objected toLilikalani as he was invariablydrunk. I went to see the Kingabout it, and he said he wouldlet Mr. Keau take his place.There were two accounts against theKing, a merchandise account and awine and spirit account. The spiritaccount of the King is settled bycash, notes, and orders on the Cus-tom House. This account was theKing's debt. It was so considered bymo and was assumed by him.

By tho Couit: You mean the ac-

count of the liquors sent over thoislands? Yes, sir.

The King owed another accountfor liquors. The King has not set-tled all his indebtedness. Ho settleda part by cash, notes, and CustomHouse orders for the remission ofduties. At stated times we wouldmake up the King's account and theduties on liquors purchased by himwere computed, and a Custom Houseorder for the amount of duties wouldbe given. The balance of the ac-

count was settled by cash and notes.At the last settlement with his Ma-jesty, this Hayseldcn account wasincluded. During the year 188G mybrother, the defendant, had a verylittle share in the conduct of thebusiness. There are two depart-ments of the business. My brotherHenry attended to the domestic partand George attended to the foreign.My brother Henry did the wholebusiness in connection with theseliquors. My brother George receivedno orders at that time. My brotherHenry made the settlement. Mybrother George was on his way toEngland when a settlement wasmade. He made one trip to SanFrancisco before the legislature ad-

journed, and after the passage ofthe loan bill he went away again.His time was devoted almost exclu-sively to the loan bill. 1 heard mybrother and Hayseldcn have somewords at the Hotel. Mr. Ilaj'seldcnsaid he hoped there was no ill feel-ing between them. My brother said,"No ; you fought very hard to defeat tlie loan bill, but you did notsucceed. I have no ill fcclinjisagainst you." This was betweenSeptember and October. Macfarlane&. Co. received some goods on theseorders. The goods that wo did nothave, they would supply, one brandin particular. Palm tree gin. Theyhad the exclusive right to sell.

I testified that my brotherHenry had general charge of thisbranch of the business. I saw theeutlies in the books, and go to bothstores every day. I did not stateexactly what goods Hayseldcn ord-ered himself. I should say about81,000 or 1,200. I should saythat Hayselden ordered about one-thir- d.

The King ordered the mostof the goods himself. 1 did not makeany claim that this was ordered by theKing, at the preliminary trial. 1answered all questions asked me.1 did not volunteer anything. II don't remember that the questionwas asked mo at tho examination.I wns only in the room with you buta few minutes. I camo up just asyou finished your examination. Yousaid, Mr. Macfarlane, I have foundeverything straight about yourbooks. You also said you took ex-

ceptions that the goods were not im-

ported by tho King. I wns awareof how the accounts were kept. Itestified that tho King asked mo tokeep this account separate.

His Majesty the King appearedon the stand and was sworn : I re-

member giving Macfarlane an orderfor liquors that I wished to havekept separato from my general ac-

count. I spoke particularly toHenry Macfarlane. The liquors sopurchased wero delivered by differ-ent orders. The goods wero boughtfor ni3' use. I directed that tho ac-

counts should bo kept in my name,and the goods delivered to the orderof Mr. Hayselden. 1 ordered somemyself, some by Lilikalani, some-times by Kapena. My liquor andmerchandise accounts were to boseparate. My liquor account wassettled by orders on tho CustomHouse and cash. 1 vnn't tell whattho amount was of the special ac-

count, It was my own account. Ithink it was settled as my account,

part by cash, nnd part by orders onthe Custom House. I hardly knowwhat proportion was settled by ord-

ers on the Custom House. 1 hadno dealings with the defendant. Allmy transactions were with Henry.1 instructed Mr. Henry Macfnilnnoto make out the account with Hay-seldcn in accordance with my in-

liveries were being made. It wasin the early part of 1S8G. 1 knowfrom deliveries going out. I havono personal supervision of thatwork. I have had nothing to dowith that account. It was all set-

tled by the clerks and my brotherHenry. 1 was on my way to SanFrancisco. I knew of its settlementafter 1 came from England. I hadbeen away between ten and elevenmonths. I left Sept. 1st 188G andreturn Oct. 8, 188G ; lett again Nov.2!Jrd and went to England, and wasgone between 10 and 1 1 months.After I returned from England Iknew of this settlement. 1 had no-

thing to do with it ; it was all doneby my brother Henry. In August1S8G 1 heard Hayselden and Henrytalking about checking over the ac-

count. This was in the office. Mybrother Henry was aimoycd withHayselden for procrastinating. Hewanted the account sent to theKing and settled. Henry on an-

other occasion was annoyed athis not attending to the checking.I made some sort of threat to suehim, so that he might attend to thematter. I think he said it was allright. Henri' alu J :ire settling it.And--I think he said, I have an orderor that he would get an order fromthe King to settle it. There wasnothing more passed between us inregard to this matter, During thosession of the legislature we werenot on good terms. T was not sowhen I spoke to him in my ollice.Wo came into collision on seveialoccasions. He was opposing theloan bill and was woiking in Mr.Spreckcls' interest. He was comingout of the Hotel one night, and Imet him. lie said, Mr. Macfarlanethe fight is over now and let usbury the hatchet. He extended hishis hand to shake hands. 1 said 1had no desire to keep up the feudand shook hands witli him. I havemet him several times since, but onlysaid good da'. What I stated be-

fore the Cabinet was what I learnedfrom my brother. 1 stated that we,referring to the firm, had sold suchgoods. My brother had all to dowith the business. I only drew in-

ferences. We looked to the King forthe payment of the account. Ilaj'-seldcn had little or no credit withthe firm at that time. He could nothave obtained S'1,000 credit without

est of tho loan bill, "which was inSeptember. I was aware of largoquantities of liquor going out onllnysclden's order. I think yousuggested the idea that it was elec-

Mr. Hatch asked that the jury bepolled.

JNIr. Peterson said it was an un-

usual thing, but he would not raiseany objection.

Mr. Hatch quoted an authoritywhich stated that as a rule the poll-

ing in a criminal case is allowed.The jury was then polled on the

containing the Governor's version ofthe annexation of tho leeward isl-

ands. This is one side of tho ques-tion and there aro so many other ac-

counts, that it is dilllcult to get atthe truth, however, I will try to givoyou tho correct account as far as Ican glean.

Mon. Lncascado being desirous ofhaving the honor of hoisting tho Hagso as to advanco in grade, etc., etc.,hurries away on board the "Decrcs"(as had ho waited another month thoadmiral would havo been here), M.L. pretends to have received ordersfrom the Homo Government, (thatalso is doubtful.) At any rate hewent off in a hurry and you read hisaccount of the comedy. How hewas received with open arms, (hewas, but they were loaded), etc.Whereas, on Ruiatca, nearly all themen are in the mountains, some 100,well-arme- and they say they willnot accept tho French flag. AtBorabora the people simply saidthey could not oppose the hoistingof . tho flag, but they protestedagainst tho hoisting thereof untilword came from England that thetreaty existing between France andEngland had been abrogated. AtHuahinc, on the 21st inst., tho Capt.of the "Awai" was on shore gettinga bath when a native (who is an"Idiot") called him a "puaa Frani."He was very wrathy and demandedhis arrest. The natives refused todo this, saying that the man was a"mama." A little while after tho"Decres" arrived with tho Governoron board.

Mon. Lc Enscigne de VasseauDenot was ordered to land with 25men and the interpreter Cadousteau.While they were on their way to theshore, a canoe was fired at by the"Awai" or "Decres," (I do notknow which), with a gatling gun.Tho canoo contained 2 women, 1man and a sewing machine, whichwas mistaken by the French forarms, (a ten gun battery pcihaps.)They did not intend to hit the canoe,but unfortunately they did. Hadthey only fired at it the womenwould have been safe. Ono reportsays: killed the two women andwounded the man in tho leg. An-other : that one woman was shot inthe head but not killed.

In the meantime, the people onshore were getting ready to leceivethe "Decre's" boat. On ncariugthe beach Cadousteau seeing theirhostile attitude called out in nativethat they were not coming to Ihjlit,etc., buthe was told to get out ofthe way, that some of their peoplewere killed, and tho natives on shorecommenced firing. The lesult wnsEnsigne Denot and 2 men were shotdead, and t mon wounded, 2 ofwhom will probably die. The fightmust have lasted between one andtwo hours. No one knows howmany natives were killed, if an', asthey wero all behind cocoanut trees,etc., and it is hard to find out howmany natives there actually werewho had guns. Some say only C,others say 20. They havo very lit-

havo plenty at Raiatca andare also armed with Winchesterlifles.

Thero is a very strong feelinghero against tho Governor and Pla-cards (written not printed) wereposted yesterday and this morning,calling him an assassin, fraudulentbankrupt, etc. They consider lieshould have waited for the Admiral.The Decrcs went away again thismorning to Huahinc, aud it is doubt-ful to say what will bo the end, asthe natives might take it into theirheads to fight. Had M. Lacascadewaited for the Admiral no lives needhavo been lost on either side asthere would havo been 400 moremen at least. As it is tho natives arenot ovorawed by superior numbersor ability. The ambition of M. L.may yet cost Franco some valuablelives and some coin, to say nothingof tho poor devils of natives. Itseems Mint England is also actingvery meanly. Why docs tho Government not send out word that thetreaty has been abrogated, and letthe poor devils know they can ex-

pect no assistance from her? InBorabora they aro praying all thotime that something may happen tokeep tho French away.

Now, of courso, I cannot vouchfor tho truth of all these reports, butto sum them up, a comedy in threeacts aud a tragedy in ono :

consciousness it atus ascertainedthat he was alliclcd with whatseemed to be nn incurable disease.

When he was able to speak he

said ho had been to his dinner and

work, when suddenly his head as

in a whirl and ho fell in the streetlike a man who is knocked down.On coming to his senses in the soli

citor's olllce he thought, what thismight mean, and feared he was

going to havo a lit of illness, vhichwc all know is a very dreadfulthing for a poor man with a familyto caic for.

With this in his mind he at once

sought the best medical advico,telling the doctors how ho had beenattacked. They questioned hiinl

and found that his piesent maladywas exhaustion of the nervous sys-

tem lesulting from general debility,indigestion, and dyspepsia of achronic nature. This in turn had

been caused by confinement to hisdesk and grief at the loss of dearfriends by death. Tho coining onof this stiange disease, as desciibcdby Mr. Richold, must be of inter-est both to sick and well. lie hadnoticed for several ycais picviously,in fact, that his eyes and face be-

gan to have a yellow; look; theicwas a sticky and unpleasant slimeon tue gums ana . tectu in memorning; tho tongue coated; andthe bowels so bound and costivethat it induced that most painfuland tioublesome ailment the piles- -.

He sajs there was some pain inthe sides and back and a 6onso offulness on the right side, as thoughthe liver weie enlarging, whichproved to be the terrible fact.The secretions fiom the kidneyswould be scanty and high-coloure-

with a kind of( gritty or sandydeposit after standing.

These things had troubled Mr.Richold a long time, and after hisfall in the street he clearly perceivedthat the fit of giddiness was nothingmore than a sign of tho stcadljand deadly advance of the complaint,which began in digestion and dys-clepsi- a.

His story of how he wentfrom one physician to another inscaich of a cure that his uifc andlittle ones might not come to want isvery pathetic and touching. Finallyhe became too ill to keep his situa-tion and had to give it up. Thiswas a sad calamity. He was appall-ed to think how he should bo able tolive. But God raised up friendswho helped to keep the wolf fromthe door. lie then went to the sea-

side at Walton-on-thc-Naz- c, butneither the change, nor the phy-sicians who treated him there, didany good. All being without availhe visited London, with a sort ofvague hope that some advantagemight happen to him in the metro-polis. This was in October, 1S8j.

How wonderful, indeed, arc theways of Providence, which dashesdown our highest hopes and thenhelps us when we least expect it.

While in London he stated his condition to a fiiend, who stiongly ad,vised him to tiya medicine which hecalled Mother fieitel's CwativcSyrup, saying it was genuine andhonest, and often cured when every-thing else had failed.
