DROIT FRANCAIS DES CONTRATS ET ARBITRAGE COMMERCIAL INTERNATIONAL

Ce numero special de la RDAI reproduit les travaux d’un colloque tenu a l’Universite de Besancon ennovembre 2016 a l’initiative du professeur Osman. Il traite des perspectives et developpements futursdu nouveau droit francais des contrats en tant que droit applicable a un arbitrage international. Ilporte notamment, sur la reception par le nouveau droit francais des contrats, des PrincipesUNIDROIT, des principes generaux de la lex mercatoria et des principes de droit europeen descontrats, de la convention de Vienne sur le contrat de vente internationale de marchandises ainsi deceux de droits etrangers recemment codifies ou recodifies. L’objectif est de rendre compte de laconcurrence entre la Civil Law et la Common Law dans le choix du droit applicable au fond du litigeen matiere d’arbitrage international.

FRENCH CONTRACT LAW AND INTERNATIONAL COMMERCIAL ARBITRATION

This special issue of IBLJ focuses on the findings of a symposium held at Besancon University inNovember 2016 and directed by Professor Osman. It addressed the future perspectives anddevelopments of the new French Law on contracts as a law applicable to international arbitration. Itdeals, in particular, with the reception by the new French Law of contracts of UNIDROIT Principles, thegeneral principles of lex mercatoria, the Principles of European Contract Law, the Vienna Conventionon the International Sale of Goods as well as recently drafted and redrafted foreign laws. The aim is toshed light on the competition between Civil Law and Common Law in the choice of the applicable lawto the merits of the dispute in international arbitration.
