REQUEST OF ESTABLISHMENT – THE ORGANIZED HAMLET OF ELKRIDGEPursuant to sections 50, 55, and 61 of The Municipalities Act, an application has been received requesting
the establishment of an Organized Hamlet within the Rural Municipality of the District of Lakeland No. 521.
IT IS HEREBY DECLARED THAT the lands described as follows and shown on the attached maps in Appendix A and Appendix B be declared an Organized Hamlet, and shall be known as the Organized Hamlet of Elk Ridge:
Lands within the projected Township 57, Ranges 27 and 28, West of the Second Meridian, described as:

IT IS FURTHER ORDERED THAT:
1 The first meeting of the voters of the Organized Hamlet of Elk Ridge be held on Monday, February 8, 2016 at 2 p.m., in the Wapiti A Room in the Elk Ridge Resort and Conference Centre.
2 Dave Dmytruk is appointed to make the necessary arrangements for the first meeting of the voters, including publication of the notice and; that shall preside at the first meeting until the voters present at the meeting elect a chairperson for the meeting.
3 A three person board shall be elected at the first meeting of the voters. The terms of office for each of the board members shall be as follows:
(a) one Hamlet Board Member shall hold office for a two year term which will expire at the annual meeting of the voters in 2018; thereafter, subject to The Municipalities Act, clause 68(3)(b), the board member will hold office for a four year term;
(b) one Hamlet Board Member shall hold office for a three year term expiring at the annual meeting of the voters in 2019; thereafter, subject to The Municipalities Act, clause 68(3)(b), the board member will hold office for a four year term; and
(c) one Hamlet Board Member shall hold office for a four year term which will expire at the annual meeting of the voters in 2020; thereafter, subject to The Municipalities Act, clause 68(3)(b), the board member will hold office for a four year term;
(d) unless there is a vacancy to fill for an unexpired term, there will be no election for a board member in 2021.
4 The first meeting of the Organized Hamlet Board shall be on Monday February 8, 2016, in the Wapati A Room in the Elk Ridge Resort and Conference Centre immediately following the first meeting of the voters.
5 The effective date of this order is January 31, 2016.

THE ALFALFA SEED DEVELOPMENT PLAN REGULATIONS –LEVY COLLECTION
Order No. 13/15. The SASKATCHEWAN ALFALFA SEED PRODUCERS DEVELOPMENT COMMISSION, pursuant to the provisions of The Alfalfa Seed Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Each buyer, processor or assembler of alfalfa seed shall deduct a levy of $0.0125 per pound of alfalfa seed marketed from any payments made to producers.
2 All marketed alfalfa seed is subject to the levy.
3 Every buyer, processor or assembler who acquires alfalfa seed from a producer shall deduct the amount of the levy from any proceeds payable to the producer.
4 Each buyer, processor or assembler of alfalfa seed shall forward to the office of the Commission the deducted levies and, using a Commission-issued form, the following information:
(a) the amount of alfalfa seed obtained from the producer;
(b) the amount of levy being paid on behalf of the producer; and
(c) the name and address of the producer.
5 Subject to any directions given by the Commission, within 55 days from the end of the month within which a levy has been collected, a buyer, processor or assembler shall submit to the Commission all such levies.
6 In the case of a buyer, processor or assembler failing to deduct a levy in respect of alfalfa seed marketed by a producer, the producer shall be held liable for the payment of the levy to the Commission.
7 With respect to section 6, a producer who has not had levy deducted by a buyer, processor or assembler shall:
(a) contact the office of the Commission to arrange for payment of the levy; and
(b) provide the information required in section 4.
8 Order No. 8/09 – Levy Collection is hereby wholly revoked.
9 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

PRODUCER REGISTRATION
Order No. 10/15. The SASKATCHEWAN FORAGE SEED DEVELOPMENT COMMISSION, pursuant to the provisions of The Forage Seed Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Each producer shall be deemed to be registered with the Commission upon:
(a) the deduction of levy fees by a buyer; or
(b) proof provided to the Commission in a form acceptable to the Commission that he or she has sold forage seed within the last two years.
2 A producer’s registration shall remain in effect until the producer ceases to pay levies for two consecutive fiscal years under the Plan.
3 The Commission shall maintain a list of registered producers including:
(a) the name under which the producer carries on his or her business along with his or her mailing address, telephone number and e-mail address when available; and
(b) in the case of a corporation, association, society or other designation operating a common production unit, the names of all the individuals involved in the production unit, their mailing addresses, their telephone numbers and their e-mail addresses when available.
4 Order No. 03/05 – Producer Registration is hereby wholly revoked.

REPORTING
Order No. 12/15. The SASKATCHEWAN FORAGE SEED DEVELOPMENT COMMISSION, pursuant to the provisions of The Forage Seed Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 On a monthly basis, a buyer shall record the amount of forage seed acquired from each producer.
2 A buyer shall report to the Commission by the 30th of the months of January and July, the amounts determined for the previous six months.
3 The Commission may request from a producer or a buyer the following information:
(a) the value of forage seed grown by a producer or to which the producer is entitled to under a crop-share arrangement;
(b) the value of forage seed marketed by a producer and the details of the marketing;
(c) the value of forage seed marketed by a producer and the manner in which the forage seed was marketed; and
(d) such other general information relating to the production and marketing of forage seed that the Commission requires to carry out the purposes of the Plan.
4 Order No. 05/05 – Reporting is hereby wholly revoked.
5 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

LEVY COLLECTION
Order No. 13/15. The SASKATCHEWAN FORAGE SEED DEVELOPMENT COMMISSION, pursuant to the provisions of The Forage Seed Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 All sales of forage seed are subject to a levy of 0.75% of the gross value of forage seed marketed upon final settlement made to producers.
2 Each buyer shall deduct the levy from any proceeds payable to a producer when forage seed is:
(a) purchased from a producer; or
(b) acquired from a producer for sale on the producer’s behalf.
3 If the levy is not deducted by the buyer, the producer is liable for payment of the levy to the Commission.
4 All levy monies must be submitted to the Commission office within 55 days from the end of the semi-annual period within which the levy was collected. Semi-annual periods are January 1 to June 30, and July 1 to December 31.
5 Using the appropriate levy remittance form as provided by the Commission, each levy submission to the Commission office must include the following information with respect to each producer for whom a levy is submitted:
(a) the name, address, phone number and email address (if available) of the producer;
(b) the crop kind purchased from the producer;
(c) the gross value of forage seed purchased from the producer; and
(c) the amount of levy being paid on behalf of the producer.
6 Order No. 06/05 – Check-Off Collection is hereby wholly revoked.
7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

(iv) any specifics of the refund request.
2 Requests for a refund that are received by the commission at its head office within the time period stated in clause 24(1)(a) of the regulations shall be considered by the commission, and the producer will be entitled to a refund in respect to the levy in question.
3 Order No. 07/05 – Refund of Check-off is hereby wholly revoked.
4 This order will remain in effect for a period no longer than ten years from the date this order is approved by the council.

GENERAL APPLICATION PRACTICE DIRECTIVE NO. 7 ADJOURNMENT OF CHAMBER PROCEEDINGS

Consent Adjournments1 Where all parties involved in an application have consented to adjourn a matter scheduled for chambers,
appropriate notice of the request to adjourn by consent pursuant to Rule 6-16(1), must be provided to the local registrar as soon as possible, and in any event, no later than 4:00 p.m. on the:
(a) Thursday preceding Monday chambers;
(b) Friday preceding Tuesday chambers;
(c) Monday preceding Wednesday chambers;
(d) Tuesday preceding Thursday chambers; or
(e) Wednesday preceding Friday chambers.
2 Where appropriate notice of the request to adjourn by consent is received in accordance with the time set out in paragraph 1, the local registrar shall adjourn the matter to the date agreed upon and no party will be required to attend chambers to speak to the adjournment unless the presiding Judge otherwise directs.
3 Where appropriate notice of the request to adjourn by consent is not received by the local registrar in accordance with the time set out in paragraph 1, the parties must:
(a) notify the local registrar as soon as possible that a request to adjourn the matter will be made; and
(b) attend chambers to speak to the adjournment unless the presiding Judge otherwise directs.
4 Pursuant to Rule 6-16, “appropriate notice of the request to adjourn by consent” means a written request to adjourn signed by all parties involved in the application (or their lawyers or agents), unless the local registrar considers it appropriate to accept an oral consent.
Adjournment Requests without Consent5 Any party seeking to adjourn a matter scheduled for chambers, without the consent of all parties involved
in the application must, as soon as possible:
(a) advise the local registrar of their intention to seek an adjournment; and
(b) whenever possible, serve and file a written explanation of the reasons for seeking an adjournment and, if known, the reasons why consent from the other parties involved in the application has not been provided.
