La mairesse expiique que cette reunion a pourobjet de rendre une decision sur la demandede demolition pour I'immeuble situe au 2307boulevard Dorchester, conformement a la Loisur I'amenagement et I'urbanisme ainsi que lereglement de demolition (1317).

Purpose of the Meeting:

The Mayor explained that the purpose of thismeeting is to render a decision on thedemolition application for the immovablelocated at 2307 Dorchester Boulevard in

accordance with the Act respecting Land UsePlanning and Development as well as By-law1317.

La mairesse expiique que le Service deI'amenagement urbain presentera d'abord leprojet, suivi par une presentation de lapersonne faisant la demande. Ensuite, toutepersonne interessee qui aura transmis descommentaires ou des oppositions au bureaudu greffier dans le delai present sera, le casecheant, invitee a presenter ses observationsau conseil. Une fois que le conseil auraentendu tous ceux et celles qui souhaitent faireune declaration, il se retirera dans la salle duComite plenier pour deliberer et, a son retour,il rendra une decision ou ajournera la seancepour rendre une decision a une date ulterieure.Si la decision est rendue, il y aura une periodede questions pour le public. Toutes lesquestions devront porter sur la demande dedemolition.

The Mayor explained that a representative ofthe Urban Planning Department will present thedemolition project, followed by a presentationby the applicant. Next, any interested personswho sent either comments or oppositions to theCity Clerk's Office within the prescribed timeperiod will be invited, as the case maybe, tomake representations to Council. Once theCouncil has heard all those who would like to

make a statement, it will deliberate in theGeneral Committee room and upon return willrender a decision or adjourn the meeting torender a decision at a later date. If the decision

is rendered, there will be a question period forthe public. All questions must relate to thedemolition application.

ATTENDU QUE le projet de construction viseepar la presente demande fait partie d'un pland'ensemble comprenant plusieurs batimentsdont la majorite est situee sur le territoire de laVille de Montreal et que ce plan a eteapprouve par les instances consultatives etdecisionnelles de celle-ci;

ATTENDU QUE seule une partie du batimenta construire (tour 1) se situe sur le territoire dela Ville de Westmount, en plus du pavilion desinfirmieres (batiment F) lequel fera I'objet d'unerestauration;

ATTENDU QUE le 6 fevrier 2018, un avispublic a ete publie dans le journal Le Devoir etaffiche sur le site de la demolition proposee;

WHEREAS the construction project covered bythis application is part of an overall plancomprising several buildings, the majority ofwhich are located on the territory of the City ofMontreal and that this plan has been approvedby its advisory and decision-making bodies;

WHEREAS only part of the building to be built(Tower 1) is located on the territory of the Cityof Westmount, in addition to the Nurses'Building(Building F) which will be restored;

WHEREAS on February 6, 2018, a publicnotice was published in the newspaper LeDevoir and posted on the site of the proposeddemolition;

QUE la demolition de la structure d'un etagesituee au 2307, boulevard Dorchester,

consecutivement a la demande du permis dedemolition portant le numero 2018-00001deposee le 3 Janvier 2018 afin de proceder aun amenagement paysager de i'espacedegage par la demolition (phase 1) afind'eventuellement realiser un projet deconstruction mixte de 32 etages, dont la partiede la construction se situant sur le territoire de

la Ville de Westmount aura un maximum de 9

etages (phase 2), soit autorisee aux conditionssuivantes :

1. Prealablement a remission du permisde demolition, un rapport de gestion duchantier pour la demolition, incluant les detailsenumeres dans I'article 69 du reglement 1300et incluant un plan de reutilisation des dechetsde demolition doit etre depose et approuve parle Bureau des inspections;

2. Prealablement a remission du permisde demolition, un rapport enongant lesmesures qui seront prises lors des travaux dedemolition pour limiter les risques dedommages au pavilion des infirmieres(batiment F), afin de favoriser la retentiond'authenticite dans le cadre de sa restauration;

3. La delivrance du permis de demolitionne peut pas preceder la delivrance du certificatd'autorisation lie a la phase 1 du projet deremplacement, soit I'amenagement paysagerde I'espace degage;

4. Les travaux vises par la phase 1 duprojet de remplacement (amenagementpaysager de I'espace degage) doivent etrerealises conformement au plan AP-100Tdepose le 7 decembre 2017 et ces travauxdoivent etre termines dans un delai maximal

de 12 mois suivant remission du certificat

THAT the demolition of the one-storeystructure located at 2307 Dorchester

Boulevard, following the application for ademolition permit bearing the number 2018-00001 filed on January 3, 2018 in order toproceed with the landscaping of the spacecleared by the demolition (Phase 1) so as toeventually complete a 32-storey mixed-construction project, of which the part of theconstruction located in the City of Westmountwill have a maximum of 9 stories (Phase 2), beauthorized under the following conditions :

1. Prior to the issuance of the demolition

permit, a site management report fordemolition, including the details listed insection 69 of By-law 1300 and including a planfor the reuse of demolition waste must be filed

and approved by the Board of Inspections;

2. Prior to the issuance of the demolition

permit, a report outlining the measures that willbe taken during the demolition work to limit therisk of damage to the Nurses' Building(Building F), in order to promote the retentionof authenticity in the building in the context ofits restoration;

3. The issuance of the demolition permitcannot precede the issue of the certificate ofauthorization related to Phase 1 of the

replacement project, namely the landscaping ofthe cleared space;

4. The work covered by Phase 1 of thereplacement project (landscaping of thecleared space) must be carried out inaccordance with plan AP-100T filed onDecember 7, 2017 and this work must becompleted within a maximum of 12 monthsfollowing the issuance of the certificate of

d'autorisation;

5. L'espace amenage (phase 1) doit etremaintenu en place jusqu'au debut des travauxde la phase 2 du projet de remplacement, cequi inclut le remplacement lorsque requis descomposantes naturelles (couvre-sol, arbustes,arbres et vegetaux) et du mobilier urbain,entretenu par le proprietaire, a ses frais, et nepas etre utilise pour entreposage ou pourd'autres activites de gestion du chantierprealablement a robtention du permis deconstruction pour la phase 2;

Prealablement a remission du permisde construction pour la phase 2 du projet deremplacement (tour 1), une strategie deconservation pour la restauration (se basantsur les Normes et Lignes directrices pour laconsen/ation des lieux patrimoniaux auCanada, defini par Pares Canada) du paviliondes infirmieres (batiment F) doit etre soumise,evaluee et approuvee par la Ville selon lesreglements d'urbanisme et municipaux envigueur;

7. La delivrance du permis de constructionpour la phase 2 du projet de remplacement(tour 1) ne peut pas preceder la delivrance desautorisations (permis ou certificats) qui serontrequises pour proceder a la restauration dupavilion des infirmieres (batiment F);

8. Les travaux vises par la phase 2 duprojet de remplacement (tour 1) doivent etrerealises conformement aux reglementsd'urbanisme et municipaux en vigueur aumoment de la demande de permis et la partiedu batiment situe sur le territoire de la Ville de

Westmount ne peut exceder une hauteur de 9etages;

9. En plus des objectifs et des criteresprevus dans le Reglement 1305, les criteressuivants s'appliquent a revaluation d'unedemande de permis de construction pour laphase 2 du projet de remplacement (tour 1) etd'un eventual certificat d'autorisation pour lestravaux d'amenagement paysager subsequent

authorization;

5. The landscaped space (Phase 1) must bemaintained in place until work on Phase 2 ofthe replacement project begins, including thereplacement of natural components(groundcovers, shrubs, trees and plants) whererequired, and street furniture, maintained bythe owner, at his expense, and not used forstorage or other site management activitiesprior to obtaining a Phase 2 constructionpermit;

6. Prior to the issuance of the construction

permit for Phase 2 of the replacement project(Tower 1), a conservation strategy (based onthe Standards and Guidelines for the

Conservation of Historic Places in Canada,

defined by Parks Canada) of the Nurses'Building (Building F) must be submitted,evaluated and approved by the City inaccordance with the urban planning andmunicipal by-laws in force;

7. The issuance of the construction permit forPhase 2 of the replacement project (Tower 1)cannot precede the issuance of authorizations(permits or certificates) that will be required toproceed with the restoration of the Nurses'Building (Building F);

8. Work covered by phase 2 of thereplacement project (Tower 1) must be carriedout in accordance with the urban planning andmunicipal by-laws in force at the time of theapplication for a permit and the part of thebuilding located on the territory of the City ofWestmount cannot exceed a height of 9stories;

9. In addition to the objectives and criteria setout in By-law 1305, the following criteria applyto the assessment of a building permitapplication for Phase 2 of the replacementproject (Tower 1) and an eventual certificate ofauthorization for landscaping work subsequentto the building permit;

definition spatiale et I'attrait du domaine public;d) Le traitement architectural desbasilaires et I'occupation du rez-de-chausseedoivent contribuer au confort, a I'animation et ala securite des espaces exterieurs;e) La conception des batiments doitfavoriser I'amenagement paysager de toits-terrasses, accessibles depuis les espacesinterieurs adjacents;f) Les enseignes doivent s'integrer auxcaracteristiques de la composition desfagades;g) Les elements mecaniques ettechniques doivent etre integres a lavolumetrie des batiments et les materiaux de

revetement utilises doivent assurer leur

integration architecturale et attenuer leurvisibilite;

h) Les persiennes de ventilation doiventpreferablement etre situees pour minimiser etattenuer leur visibilite de la rue;

I) L'amenagement et la localisation desacces vehiculaires doivent minimiser leurs

impacts visuels et assurer la securite et leconfort des pietons;j) Les espaces libres exterieurs doiventetre amenages en continuite avec le domainepublic adjacent, incluant les trottoirs et lesespaces de pares publics;k) L'amenagement paysager des espaceslibres et des aires de detentes exterieures doit

privilegier les elements vegetaux et s'integrerharmonieusement aux espaces publicsadjacents;

a) The layout, volume and architecturaltreatment must contribute to the developmentof the Nurses' Building (Building F) andintegrate into the language of the site's multi-use complex with the towers and its basilaire;

b) All fagades visible from the public road mustbe treated with the same care as the main

fagades, especially in regards to the choice ofmaterials and openings;

(c) The architectural treatment of basilaria mustcontribute to enhancing the spatial definitionand attractiveness of the public domain;d) The architectural treatment of basilaria andthe occupation of the ground floor mustcontribute to the comfort, animation andsecurity of the outdoor spaces;e) The design of the buildings must encouragethe landscaping of rooftop terraces accessiblefrom adjacent Interior spaces;

f) Signs must integrate with the characteristicsof the composition of the fagades;

(g) The mechanical and technical elementsmust be integrated into the volume of thebuildings and the coating materials used mustensure their architectural Integration andreduce their visibility;

h) Ventilation louvers must preferably belocated to minimize and mitigate their visibilityfrom the street;

i) The layout and location of vehicular accessmust minimize their visual impact and ensurethe safety and comfort of pedestrians;

j) Outdoor open spaces must be developed incontinuity with the adjacent public domain,including sidewalks and public park spaces;

k) Landscaping of open spaces and outdoorrelaxation areas must prioritize plant elementsand blend harmoniously with adjacent publicspaces;

doivent etre fragmentes en plusieurs plans defagade de fagon a briser leur masse et aattenuer leur horizontalite

n) La composition de la Tour 1 doitfavoriser une continuity architecturale avec le

basilaire de la rue Tupper tout en privilegiantune integration architecturale harmonieuseavec le batiment F et les lots avoisinants.

10. Prealablement a remission du permisde demolition, une garantie monetaired'execution du programme preliminaire deremplacement de la phase 1 du projet deremplacement (amenagement paysager deI'espace degage) de 500 000 $ (cinq-centmille) doit etre fournie conformement a I'article22 du reglement 1317, et doit demeurer envigueur jusqu'a I'achevement des travauxautorises par le certificat d'autorisation lie a laphase 1 du projet de remplacement.

11. La presente decision devient caduquesi une demande complete de certificatd'autorisation pour la phase 1 du projet deremplacement n'est pas transmise a la Villedans un delai de 12 mois a partir de la date dela decision.

Adoptee a l'unanimite

I) The location and layout of loading docks,including their access routes, must be safe andadapted to adjacent outdoor relaxation areasand pedestrian traffic areas;

m) On the Atwater Avenue side, the built-upvolumes located above the basilaire must be

broken up into several fagade planes so as tobreak-up their mass and reduce theirhorizontality.n) The composition of Tower 1 must fosterarchitectural continuity with the basilaire ofTupper Street all while favouring harmoniousarchitectural integration with Building F andneighboring lots.

10. Prior to the issuance of the demolition

permit, a monetary guarantee for the executionof the preliminary replacement programme forPhase 1 of the replacement project(landscaping of the cleared space) of $500,000 (five hundred thousand) must beprovided in accordance with section 22 of Bylaw 1317 and must remain in force until the

completion of the work authorized by thecertificate of authorization related to Phase 1 of

the replacement project.

11. This decision becomes void if a completeapplication for a certificate of authorization forPhase 1 of the replacement project is not sentto the City within 12 months from the date ofthe decision.
