PRÉSENTAT ION DU CONGRÈS
Dans le cadre des manifestations scientifiques programmées régulièrement sous l’égide du Comité de Recherche en Sociologie du Droit de l’Association Internationale de Sociologie (ISA/RCSL), il a été décidé d’organiser du 3 au 6 septembre 2013 un congrès mondial de sociologie du droit. Ce congrès aura lieu à l’Institut d’Etudes Politiques de Toulouse avec comme thème général : Sociologie du droit et action politique.
Le Comité de Recherche en Sociologie du Droit de l’Association Internationale de Sociologie (ISA/RCSL) est une des expressions d’une organisation internationale de la politique d’échanges scientifiques par sociologie spécialisée. Néanmoins, au cours des années récentes, il est apparu que l’objet de cette sociologie spécialisée – le droit et ses mises en œuvre notamment via l’action de la justice –, conduisait de plus en plus à traiter de processus généraux qui, au-delà du droit, concernaient les modes de structuration, de fonctionnement, de régulation des sociétés dans leur ensemble. Les travaux de recherche sur le droit ont ainsi progressivement retrouvé logiquement une filiation longtemps perdue avec les grandes figures fondatrices de la sociologie pour qui l’intérêt porté au droit ne visait pas seulement à mieux connaître le droit, mais également à donner sens, par le biais de l’analyse du droit, aux grandes transformations de nos sociétés et à leur devenir.
C’est dans ce même esprit qu’a été choisi le thème général de ce congrès. Le traitement de ce thème poursuit un double objectif : ne pas cantonner la sociologie du droit à une spécialisation étroitement définie mais la mobiliser en relation avec ce qu’elle peut apporter pour comprendre les grandes mutations de nos sociétés ; inscrire les travaux prévus dans ce congrès dans un courant international de recherche en pleine effervescence sur les rapports entre droit et politique. Depuis quelques années s’observent, en effet, des métamorphoses de la régulation politique qu’on pourrait schématiquement caractériser de la façon suivante : substitution de la notion de gouvernance à celle de gouvernement, relativisation du poids de l’Etat-nation dans le cadre de la globalisation, transformations des modes d’intervention de l’Etat marquées notamment par la relativisation des processus de décision top-down justifiant en particulier la substitution de la notion d’action publique à celle de politique publique, crise de la démocratie représentative, redéfinition des rapports entre légalité et légitimité corrélative de la crise du modèle weberien légal-rationnel de domination, nouvelles formes de mobilisation de la société civile, etc.
De telles évolutions ont favorisé de nouvelles orientations de recherche en sociologie du droit qui ont elles-mêmes participé de nouveaux investissements des sciences sociales, particulièrement de la science politique, de la sociologie générale, de l’histoire et du droit lui-même (plus spécialement du droit public) dans ce qu’on pourrait appeler cette nouvelle économie de la légalité en rapport avec le politique. Ce mouvement est si fort qu’il a contribué à rapprocher fortement la recherche américaine sur le droit et la justice, depuis longtemps inscrite dans les analyses consacrées au politique (le droit et la justice y sont traditionnellement des objets de science politique), de la recherche européenne et particulièrement de la recherche française concernée, longtemps cantonnée à n’être qu’une sociologie du droit pour le droit, plus encore pour le droit de l’Etat. Dans une sorte de débordement dynamique et exceptionnellement novateur de cette stricte sociologie du droit, celle-ci s’est délibérément ouverte à des approches où importait de moins en moins le fait de savoir si les frontières d’une sociologie spécialisée étaient respectées, ce qui veut dire que la nature des problèmes posés dans cette économie des relations entre droit et politique prévalait sur la question de savoir s’il s’agissait de sociologie du droit ou, par exemple, de sociologie, de science politique ou d’histoire.

C’est ainsi que, logiquement, des travaux se sont multipliés sur des formes de production du droit comme révélateurs de processus politiques, de politiques publiques ou plutôt d’action publique. Le droit n’a plus été vu seulement comme référence mais comme une ressource susceptible d’apparaître dans les nouveaux répertoires de l’action collective mise en œuvre par des mouvements sociaux ou encore comme instrumentalisée par une action politique obnubilée par le « culte de l’efficacité » au détriment des « exigences de la légalité » (la « managérialisation du droit »). Une nouvelle représentation du droit s’est également imposée, selon laquelle celui-ci a été perçu comme constitutif de la réalité sociale et non plus comme participant d’appareils institutionnels destinés à intervenir sur cette réalité sociale (courant du «legal consciousness»). Une telle représentation du droit favorise alors un travail de redéfinition des rapports des citoyens à la norme juridique en référence à la réalisation véritable du projet démocratique. Dans ces bouleversements du statut du droit et de ses représentations sociales, les professionnels du droit prennent une importance particulière : ils deviennent des acteurs importants du jeu politique dans la mesure où ils disposent de cette compétence particulière qui est précisément de maîtriser l’usage de la ressource juridique. Le courant international du «cause lawyering» est une des expressions de cette nouvelle orientation. Bien entendu, du constat du phénomène de globalisation découle l’intérêt croissant porté aux transformations du statut du droit, à ses nouveaux rôles de même qu’à ceux de la justice, engagée dans des territoires supra-nationaux et qui tente elle-même de redéfinir ses fonctions dans le cadre de ces nouvelles échelles territoriales. Enfin comme illustration parmi beaucoup d’autres du fait que le droit et la justice font système avec le politique, la recherche se penche sur ce qu’il est convenu d’appeler la « judiciarisation du politique » signifiant pour certains un déplacement de l’Exécutif et du Législatif vers le judiciaire pour assurer la régulation du politique.
Le programme du congrès est fortement inspiré par ce nouveau régime de connaissance sur ces mutations dans l’économie de la légalité. Il est conçu pour permettre d’approfondir certains de ses aspects : soit dans le cadre de séances plénières où sont invités à intervenir les meilleures spécialistes mondiaux des thèmes choisis, soit dans le cadre des workshops, au nombre d’une cinquantaine, témoignage des multiples déclinaisons des analyses possibles des rapports entre droit, justice et politique.
Bien entendu, , l’importante participation à ce Congrès est, en toute logique, conforme à la conception de la sociologie du droit telle qu’elle a été développée supra. L’ampleur des enjeux de connaissance soulevés par cette mise en relation du juridique avec le politique, exige la pluridisciplinarité la plus large. L’implication de l’Institut d’Etudes Politiques de Toulouse dans ce projet constitue à la fois le témoignage et la garantie d’un engagement de la science politique (renforcé par le soutien accordé par l’Association Française de Science Politique et le Réseau Européen Droit et Société). Mais la participation de représentants d’autres disciplines de sciences sociales s’impose également à l’évidence, de même, bien entendu, que celle de juristes. À ce propos, n’oublions pas que c’est à des juristes que le RCSL doit son existence, ainsi que cela a été rappelé à l’occasion de son 50ème anniversaire, célébré en 2012 à Varsovie.

As a part of its regular activities, the Research Committee on Sociology of Law (RCSL) of the As part of its regular activities, the Research Committee on Sociology of Law (RCSL) of the International Sociological Association (ISA) jointly with Sciences Po Toulouse are organising, the 2013 International Congress on the Sociology of Law, taking place in Toulouse between 3rd and 6th September, called: “Sociology of Law and Political Action”.
Over recent years, it has proved to be necessary to discuss the topics of the RCSL’s specialty – Law and its implementation, notably by courts – in strong connection with the study of broader processes regarding, beyond the law, the modes of structuring, functioning, and regulating of societies in general. Research in the field of law has thereby found the way back to the main founding fathers of sociology, for whom law deserved special interest not only for itself but also because its analysis was considered as a prerequisite for a meaningful interpretation of major social changes.
These were the motives that led to the main topic of the congress. Its discussion has two aims: to tackle broad current social changes likely to be illuminated by socio-legal research, rather than to narrowly focus on socio-legal issues; and to take advantage of an international trend in scientific research strengthening the connections between law and politics. Indeed, over the last years, we have observed deep-rooted transformations of political regulation. The government as a notion is replaced by governance; Nation States are losing their meaning in the course of globalization; their modes of intervention are shifting from top-down decision processes to more complex processes of negotiation and regulation, forcing analysts to replace the concept of public action by the one of public policy. Representative democracy is said to be in a crisis; the relationship between legality and legitimacy has to be redefined as a result of the shortcomings of the Weberian legal-rational model of domination; civil society is inventing new forms of mobilization, etc.
These evolutions did improve new research trends in Sociology of Law, which also correspond to more general new trends in Social Sciences, in particular in Political Sciences, Sociology, History, and Jurisprudence, especially in the field of Public Law. These trends are bringing about a new economy in the relationship between legality and politics. They have contributed to narrowing the gap between research on Courts (e.g. research in the United States, where law and justice are topics traditionally addressed by political sciences; also research in Japan) and research oriented by the needs of jurists, focussing mainly on the State’s law (which is in particular, the case for European and in especially French socio-legal research). Furthermore, they have triggered a dynamic renewal of sociology of law, today less concerned with its identity and frontiers of sociological specialty than with the challenging issue of the changing relationship between law and politics.
Consequently, there has been more and more research on the production of law as revealing political processes ; on the law viewed not as a mere reference, but as a resource among others for the action of social movements, as well as for public policies aiming at achieving “efficiency”, even at the expense of the “requirements of legality” (“managerialization of Law”); on the law as participating in the construction of social reality beyond the intervention of official entities supposed to act upon this reality (see the debate on legal consciousness). Such a legal concept favours a new definition of the relationship between citizens and legal norms with a view to the accomplishment of the democratic project. In these dramatic changes of law and of legal consciousness, legal professions are gaining special relevance. People skilled in the use of the legal resource are becoming key players in the political game (see the international research stream on “cause lawyering”). The debate on globalization gives increasing relevance to Law and Courts in supra-national territories. Last but not least, let us remember the research on “Legalization of Politics”.

The program of the Congress is strongly inspired by this new knowledge regime, linked to the transformations of the nature, role, and place of law today. It is designed to discuss aspects of these transformations in plenary sessions gathering internationally recognized specialists, as well as in workshops mirroring the plurality of possible different approaches to the relationship between law, justice, and politics.
The main topic chosen requires a broad interdisciplinary approach. The involvement of the Sciences Po Toulouse, and the support of the French Political Sciences Association as well as the European Network on Law and Society, reveals the strong commitment of French political sciences in this exercise. Other social sciences are obviously also welcome such as jurists, to whom RCSL owes its existence, as we had the opportunity to remember at the occasion of its 50th anniversary, celebrated last year in 2012 in Warsaw.

La ligne A du métro permet de traverser Toulouse, de Basso-Cambo à Balma Gramont, en 22 mn à 27 mn selon les horaires.

Orientée sud-ouest/nord-est, la ligne A, ponctuée de 18 stations, s’étend sur 12,5 km. Chaque station est dotée d’une œuvre d’art différente.
La ligne B du métro compte 20 stations, 15,8 kilomètres de tracé entre Borderouge et Ramonville-Saint- Agne. Elle traverse Borderouge, La Vache ou Niel, s’arrête au coeur de quartiers anciens typiques, comme les Minimes ou Saint-Michel et marque des arrêts dans plusieurs grands ensembles, tels Empalot, Saouzelong ou Rangueil. Elle dispose de stations à proximité de secteurs prestigieux du vieux Toulouse : François Verdier, Carmes et Palais de Justice. Enfin, elle permet d’accéder à l’hyper-centre et aux activités de commerces, de services et de loisirs.
Bus
Les bus desservent des lignes urbaines complémentaires, auxquelles se rajoutent des navettes, des taxis-bus et des transports à la demande.
La navette gratuite, avec son tracé en boucle autour de l’hyper-centre, est très appréciée des toulousains et des visiteurs.
Un réseau de nuit spécifique dessert tous les grands axes de Toulouse depuis et vers la Gare Matabiau en complément de la ligne A du métro.

Vous pouvez retirer un vélo dans l’une des 242 stations VélôToulouse. VélôToulouse est un système de vélos en libre-service ouvert 24h sur 24. Libre et autonome, vous pouvez utiliser le service dès que vous le souhaitez, en vous y abonnant ou en l’utilisant à la journée.

Pour le stationnement, la ville compte de nombreux parkings totalisant environ 9000 places. Répartis sur tout le centre-ville, la plupart sont ouverts 24h/24h et proposent des tarifs à l’heure ou à la journée.

Passez sous le porche central, traversez la cour intérieure, prenez la dernière porte à gauche, la Salle des Colonnes se situe au premier étage.

L’entrée se situe sur votre droite au niveau du portail bleu à côté de la cathédrale.

A la sortie du métro, prendre la Rue de la République en direction du Pont-Neuf. L’Hôtel-Dieu Saint-Jacques se situe à gauche avant le pont.
A pied : Depuis la Préfecture, prendre à gauche, tournez à droite Rue Boulbonne, tournez à gauche Rue de Metz, continuez tout droit et traversez le Pont-Neuf. L’Hôtel-Dieu Saint-Jacques se situe à droite après le pont.

On your arrival, please do present yourself at the reception, in order to confirm your presence and receive your welcome bag, which will contain all the necessary material for the Congress:
- your access badge - a welcome booklet detailing together, the scientif ic and social program - a USB key (under the shape of a digital card), which contains the welcome booklet as well as all the abstracts of the papers to be presented. - your personal invitation to the various Receptions, by the Mayor of Toulouse, by the Prefect, and to the Galeries Lafayette and the Bookshop ‘Ombres Blanches’. - your lunch tickets, for the breakfast of September 3rd, 4th and 5th, 2013 - in option, your pass to the Gala Dinner and/or the Dinner Cruise - your Pass Transport Tisséo to move around the city during the Congress - documents with practical and tourist informations, a city map and a map of the public transports - notepad, pencil, etc.
If you benefited from the France / KLM preferential rate, don’t forget to stamp your flying ticket at the reception of the Congress in order to justify it.
A welcome breakfast is planned on Tuesday, September 3rd, 2013 from 8 am to 9:30 am in the inner courtyard, under the marquee. Coffee breaks and lunches also will be served on the same place.
For lunch, 2 services are planned: from 12 am to 1 pm and from 1 pm to 2 pm. Please, check your lunch ticket, which you will find in your welcome bag.
All the Plenary Sessions will take place in the Building B. The lecturers will talk in the Amphitheater MB1, and an audiovisual retransmission is planned to be held in the amphitheater MB2.
The working-groups and workshops will take place on the afternoon, in the Building D, on the ground floor and the 3rd floor.
Each room is equipped with a computer and a video-projector. Thank you for preparing your screen shows on an USB key, which you will just have to insert into the computer.
A computer room (Building E, Basement, Room -003) will be opened to the same schedules as the reception.

In the Hall of the Congress, a ‘Partners and Publications’ space will be held. This area will be devoted to the exhibition and sale of books related to the theme of the Congress.

Pass Transport TISSEO
Upon his/her arrival, each participant will receive a Pass Transport TISSEO offered by our partner So Toulouse. It allows an unlimited intramural access to buses and subway during the period of the Congress. The network bus-metro of Toulouse is very comprehensive, and will let you move around everywhere in town, easily.

Subway
The subway line A allows you to go through Toulouse, from Basso-Cambo to Balm Gramont (about 22 to 27 minutes according to the timetable).
For a tour in Toulouse, the stations the most popular are located within the ‘hyper-center’. Hereafter, are the most famous underground stations of the City Center:
- Capitole, next to the famous place of the same name - Jean Jaurès, for accessing to the Wilson Place and its cinemas/movie theaters - Esquirol and its direct access to the street Saint Rome (for shopping) - Saint Cyprien, located on the splendid left bank of the Garonne
Facing south-west/north-east, the A line and its 18 stations stretch on 12,5kilometers (or 7.6miles). Each station is decorated with a different work of art.
The B line includes 20 stations, 15,8 kilometers long (or 11.5 miles) between Borderouge and Ramonville-Saint-Agne. It goes through Borderouge, La Vache or Niel, and stops in the center of typical old area, such as les Minimes or Saint-Michel and also stops at some main places such as Empalot, Saouzelong or Rangueil. These stations are close to prestigious areas of the old Toulouse: François Verdier, Carmes and Palais de Justice.
Bus
Buses provide a bigger city network, as well as shuttles, taxi-buses and transports on demand. The free shuttle, with its looped layout/circuit around the hyper-center, is really appreciated by people from Toulouse and visitors/tourists. On the night, a network offers transport on the main lines of Toulouse from and to the Railway Station Matabiau, as a supplement of the subway line A.
Bike
You can borrow a bike to one of the 242 stations of VélôToulouse. VélôToulouse is a self-service open 24 hours a day. You can use this free and autonomous service whenever/as soon as you want to, by subscribing it, or for along the day.
Cars
Informations about the car traffic in real time are available online on the Toulouse Déplacements website. For parking, the city has about 9 000 parking places. Spread all over the city, most of them is open 24 hours a day and suggest an hour rate or a day rate.

On foot: leaving the Manufacture des Tabacs towards your right and then turn right onto the Quai Saint-Pierre, walk along the Garonne to the Pont Neuf, take a left into Rue de Metz, then turn right onto Rue Boulbonne, then turn left. The entry is situated on your right at the blue gate next to the cathedral.
To go to the Hôtel-Dieu Saint-Jacques:

On leaving the subway, take the Rue de la République towards the Pont-Neuf. The Hôtel-Dieu Saint-Jacques is situated on your left before the bridge.
By walk: From the Prefecture, leave the building towards the left, take a right onto Rue Boulbonne, then take a left onto Rue de Metz, go straight and cross the Pont-Neuf bridge. The Hôtel-Dieu Saint-Jacques is situated on your right after the bridge.
To go to the Ombres Blanches Bookshop:
