BALTIMORE CITY CHARTER PROVISIONS 

ARTICLE III ­ CITY COUNCIL  

Section 7.  Council districts.  (a) Criteria for redistricting. The City shall be divided by ordinance into districts for the election of members of the City Council. The criteria in redistricting  shall  be  equality  of  population,  contiguous  territory, compactness, natural boundaries, existing council district lines, and the standards established by the Supreme Court of the United States.  (b) Redistricting plan.   Following  each  census  of  the United  States  the Mayor  shall  prepare  a  plan  for  council  redistricting.  The  Mayor  shall present  the  plan  to  the  City  Council  not  later  than  the  first  day  of February of the first municipal election year following the census.    After the Mayor’s plan is presented to the City Council, the Council may adopt  it or amend  it or  the City Council may adopt another plan.  If no plan  has  been  adopted  by  the  City  Council within  sixty  days  after  the Mayor’s  plan  is  presented,  the  Mayor’s  plan  shall  take  effect  as  the redistricting ordinance.  (c) {Vacant}  (d)  Incumbent’s  residency.    No  member  of  the  City  Council  shall  be required to vacate that office by reason of a change of boundary lines of that member’s council district made during that member’s term, as long as that member remains a resident of Baltimore City.  (e) Residency duration for next election. For elections following the adoption of redistricting plans, members of the City Council shall have been residents of the districts they have been chosen to represent since the preceding July 1. (Initiative (“Question P”), ratified Nov. 5, 2002.)

INTRODUCTION TO REDISTRICTING  

 

What is Redistricting?   The United States Congress, state  legislatures, city and county councils and some local school boards represent voters within specified electoral districts.  Redistricting  is  the  process  of  redrawing  the  boundaries  of electoral districts from which representatives are to be elected.   Redistricting  for Baltimore City  is  the process of dividing  the City  into districts of approximately equal population for the election of members to  serve  on  the  City  Council.  In  Baltimore  City,  Council  Members represent  distinct  geographical  areas.  These  areas  are  called  council districts.  The  Baltimore  City  Charter  requires  fourteen  (14)  council districts  with  a  single  member.  Baltimore  City  redistricts  after  the decennial census  is completed and new population data  is available  to accurately  distribute  the  population  among  districts.  The  last redistricting  plan  for  Baltimore  City  was  adopted  March  25,  2003  by Ordinance  #03‐506  (City  Council  Bill  #03‐0852).  (see  Redistricting  in Baltimore City, Section 1).  

Redistricting v. Reapportionment   Redistricting  is  different  from  reapportionment,  which  is  the assignment of seats in the U.S. House of Representatives to states based on  their  population.  Changes  in  population  as  indicated  by  decennial Census data help determine how many seats are assigned to each state. The  larger  the population,  the more  congressional  representatives  the state will be apportioned. Reapportionment is a requirement of Article I of  the  U.S.  Constitution  (see  U.S.  Constitution,  Article  1  on  page  6  of Section  II).  Unlike  redistricting,  reapportionment  does  not  involve drawing a map. It is based only on the division of population to calculate the number of congressional seats for each state.

Census   Article  I,  Section  2  of  the  United  States  Constitution  (see  page  6  of Section  II)  requires that the number of persons  in the United States be counted  every  ten  (10)  years  for  the  purpose  of  apportioning representatives. This process  is  known as  the decennial Census and  is conducted  in  the  years  ending  in  zero  (e.g.,  1980,  1990,  2000).  The Supreme Court of  the United States held  in  the cases of Baker vs. Carr (1962) and Reynolds vs. Simms (1965) that Federal and local legislative districts  must  be  redrawn  after  each  census  so  that  districts  are  of approximately  equal  population.  Census  data  will  be  released  in February  2011  for  the  current  redistricting  process.  The  new  data provides  information  about  the  population,  age  and  race  of  City residents. The new Census data will be used to redraw the City electoral boundaries (also called City Council districts).   

The Voting Rights Act of 1965   The  Voting  Rights  Act  of  1965  was  originally  enacted  to  prohibit election practices that excluded minorities from exercising their right to vote. During the 1960's and 70's, the U.S. Department of Justice used its provisions  to  enforce  prohibitions  on  election  practices  such  as  poll taxes,  literacy tests, and other prerequisites to voting that discouraged minorities from voting.   Once  direct  obstructions  to  voting  were  more  or  less  eradicated  by enforcement  of  the  Act,  the  focus  changed  to  the  effects  of gerrymandering on minorities.  Many state redistricting plans were held to  be  in  violation  of  the  Act  because  they  included  districts  that  had been  drawn  in  such  a way  as  to  dilute  a minority  population's  voting strength,  usually  by  spreading  a  compact  minority  population  across several  districts.  These  standards  for  these  cases  is  set  forth  in  a  U.S. Supreme  Court  decision,  Thornburg  vs.  Gingles,  478  U.S.  30,  which emphasized two provisions of the Act; Sections 2 and Section 5.

Section 2(a) (in part), Voting Rights Act of 1965   No voting qualification or prerequisite to voting or standard, practice, or procedure shall be imposed or applied by a State or political subdivision in a manner which results in a denial or abridgement of the right of any citizen of the United States to vote on account of race or color.  This  section  covers  all  jurisdictions and  is  almost  exclusively  enforced by lawsuits instituted against states or political subdivisions by the U.S. Department of Justice or other private parties.   

Section 5, Voting Rights Act of 1965   Section 5 of the Voting Rights Act requires certain covered jurisdictions around  the  country  to  have  all  changes  in  voting  qualifications, standards,  practices,  or  procedures  approved  by  the  Civil  Rights Division of  the U.S. Department of  Justice or  the U.S. District Court  for the  District  of  Columbia.  This  procedure  is  commonly  known  as "preclearance" and applies  to  redistricting plans proposed  in  "covered jurisdictions." Maryland is not a jurisdiction covered under Section 5.   

14th Amendment, U.S. Constitution  In  addition  to  the  equal  population  requirement,  the  Equal  Protection Clause of the 14th Amendment to the U.S. Constitution also limits racial and  political  gerrymandering.  (See  the  glossary  for  definition  of gerrymandering)   

Racial Gerrymanders   In  1993,  the  U.S.  Supreme  Court  ruled  that  redistricting  plans  that include  some  majority  minority  districts  violate  the  Equal  Protection Clause  if  they are drawn primarily  in consideration of race.  In Shaw v. Reno,  509  U.S.  630  and  subsequent  cases,  the  court  has  said  that  a violation occurs when race is the predominant consideration in drawing district  lines  and when other,  traditional  districting principles  such  as compactness  and  regard  for  political  subdivision  boundaries  are

ignored in favor of race. Generally, such districts are extremely irregular and cannot be explained as anything other than an attempt to create a district  according  to  race.  The  court  explained  that  there  was  an inherent danger in the classifying of citizens on the basis of race. Thus, states  can  only  create  majority  minority  districts  where  they  are reasonably compact and take into consideration factors other than race.   

Partisan Gerrymanders   In 1986, a divided U.S. Supreme Court recognized the legal claim that a redistricting  plan  could  unconstitutionally  discriminate  against  a minority party. In Davis v. Bandemer, 478 U.S. 109 the court said that if a  redistricting  plan  substantially  interfered  with  a  minority  party's ability  to participate  in  the electoral  process  to  the point  that party  is effectively  shut  out  of  the  legislative  process  altogether,  a  violation  of the  14th  Amendment  would  occur.  Since  this  decision,  no  challenges have  been  successful  at  proving  the  requisite  discriminatory  effect needed to prove a case of political gerrymandering.   

Redistricting in Baltimore City   In Baltimore, the Mayor and City Council are responsible for redrawing city council districts as set forth in Article III, Section 7, of the Baltimore City Charter.  The Mayor submits a redistricting plan to the City Council for adoption and/or amendment.     The City Council may also adopt  its own redistricting plan. (See Section I)  Criteria set by the City Charter for redistricting are:  

 1. equality of population 2. contiguous territory 3. compactness  4. natural boundaries  5. existing council district lines  6. standards set by the U.S. Supreme Court.

U.S. Supreme Court Standards   Standards  set  by  the  U.S.  Supreme  Court  in  various  decisions  depend upon  the  authority  from  which  the  standard  is  derived.  The  most important  standards  are  those whose  authority  is  found  in  the United States  Constitution.  The  next most  important  are  those  set  by  Acts  of Congress.  The  final  set  are  those  the  court  deems  essential  to  proper interpretation of the constitution and statutes.   As interpreted by the U.S. Supreme Court, the Equal Protection Clause of the 14th Amendment to the United States Constitution requires equality of population and is regarded as the most important standard set by the Court. As previously mentioned, the court gives a  little more leeway to local  government  redistricting  than  to  congressional  or  legislative redistricting  (see Abate  v. Mundt  case, pages 10­11 of  Section  II).    Still, most authorities recommend that local governments not exceed a 10 % population variance.1  Racial equality is required by the Voting Rights Act of 1965 as amended in 1982, and is often considered as second only to population equality in the  court  decisions.  The  simple  rule  to  remember  is  the  mapmaker should  make  a  reasonable  effort  to  draw  a  district  where  minority group members are a majority.2  Contiguousness is held by the court to be required by good public policy but  is  viewed  as  less  important  than  the  constitutional  and  legislative requirements.3  Compactness  is  a  consideration  and becomes  relevant when  the  court suspects  some  other  misconduct  (e.g.,  gerrymandering  or  racial inequality)4   1 Baker vs. Carr 369 US 186, 82.S.Ct.691., 7 L.Ed 2nd.,663 (1962), Reynolds vs. Sims 377 U.S. 533, 84 s.CT. 1362, 12 L.Ed 2'·. 506 (1964); Abate vs. Muodt 403 U.S. 182,91 S.C!. 1904, 29L.Ed 399 (1971).  2 42.U.S.C. SEC. 1973c. United Jewish Organizations of Williamsburgh, lac. vs. Carey 430 US 144 (1977) White vs. Register 412 U.S. 755 (1973).  3 Davis vs. Bbandemer U.S. 109 (1986).   4 Karcher vs. Dagett 462 U.s. 725 (1983)

THE CONSTITUTION OF THE UNITED STATES  ARTICLE I  

Section 2.  The House of Representatives shall be composed of Members chosen every  second Year by  the People of  the  several  States,  and  the Electors in each State shall have the Qualifications requisite for Electors of the most numerous Branch of the State Legislature. 

No Person shall be a Representative who shall not have attained to the Age of  twenty  five Years, and been seven Years a Citizen of  the United States, and who shall not, when elected, be an Inhabitant of that State in which he shall be chosen. 

(Representatives and direct Taxes shall be apportioned among the several States  which  may  be  included  within  this  Union,  according  to  their respective Numbers, which  shall  be  determined  by  adding  to  the whole Number of  free Persons,  including  those bound  to Service  for a Term of Years, and excluding  Indians not  taxed,  three  fifths of all other Persons.) (The previous  sentence  in parentheses was modified by  the 14th Amendment, section 2.) The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct. The Number of Representatives shall not exceed one for  every  thirty  Thousand,  but  each  State  shall  have  at  Least  one Representative; and until such enumeration shall be made, the State of New Hampshire shall be entitled  to choose  three, Massachusetts eight, Rhode  Island  and  Providence  Plantations  one,  Connecticut  five,  New York six, New Jersey four, Pennsylvania eight, Delaware one, Maryland six,  Virginia  ten,  North  Carolina  five,  South  Carolina  five  and  Georgia three. 

When  vacancies  happen  in  the  Representation  from  any  State,  the Executive  Authority  thereof  shall  issue  Writs  of  Election  to  fill  such Vacancies. 

The  House  of  Representatives  shall  choose  their  Speaker  and  other Officers; and shall have the sole Power of Impeachment.

BAKER v. CARR, 369 U.S. 186 (1962) (USSC+) 

 In this decision, the U.S. Supreme Court ruled that a person could challenge, and seek judicial redress jar an allegedly improper redistricting plan. Legislatures were forced to draw redistricting plans consistent with constitutional and statutory requirements or else have the districts drawn by the courts.  

Syllabus  Appellants  are  persons  allegedly  qualified  to  vote  for members  of  the General Assembly of Tennessee representing the counties in which they reside. They brought suit in a Federal District Court in Tennessee under 42 U.S.C §§ 1983 and 1988, on behalf of themselves and others similarly situated,  to  redress  the  alleged  deprivation  of  their  federal constitutional  rights  by  legislation  classifying  voters  with  respect  to representation in the General Assembly. They alleged that, by means of a  1901  statute  of  Tennessee  arbitrarily  and  capriciously  apportioning the seats in the General Assembly among the State's 95 counties, and a failure  to  reapportion  them  subsequently  notwithstanding  substantial growth  and  redistribution  of  the  State's  population,  they  suffer  a "debasement  of  their  votes,"  and  were  thereby  denied  the  equal protection of the laws guaranteed them by the Fourteenth Amendment. They sought, inter alia, a declaratory judgment that the 190 I statute is unconstitutional  and  an  injunction  restraining  certain  state  officers from  conducting  any  further  elections  under  it.  The  District  Court dismissed the complaint on the grounds that it lacked jurisdiction of the subject matter and that no claim was stated upon which relief could be granted.   Held:  

1. The  District  Court  had  jurisdiction  of  the  subject  matter  of  the federal  constitutional  claim  asserted  in  the  complaint.  Pp.  198‐204  

2.  Appellants had standing to maintain this suit. Pp. 204‐208  3. The  complaint's  allegations  of  denial  of  equal  protection 

presented a  justifiable constitutional cause of action upon which appellants are entitled to a trial and a decision. Pp. 208‐37

REYNOLD v. SIMS, 377 U.S. 533 (1964) (USSC+) OPINIONS 

WARREN, C.J., OPINION OF THE COURT III  In  this  decision  the  U.S.  Supreme  Court  ruled  that  legislative  districts should be drawn to provide equal weight 10 every person's vote. (i.e. one person, One voce.)    Legislators represent people, not trees or acres. Legislators are elected by voters, not farms or cities or economic interests. As long as ours is a representative  form  of  government,  and  our  legislatures  are  those instruments  of  government  elected  directly  by  and  directly representative of  the people,  the right  to elect  legislators  in a  free and unimpaired fashion is a bedrock of our political system. It could hardly be  gainsaid  that  an  unconstitutional  claim  had  been  asserted  by  an allegation  that  certain  otherwise  qualified  voters  had  been  entirely prohibited  from voting  for members of  their  state  legislature. And  if  a State should be given two times, or five times, or ten times the weight of votes of  citizens  in another part of State,  it  could hardly be contended that  the right  to vote of  those residing  in  the disfavored areas had not been effectively diluted. It would appear extraordinary to suggest that a State could be constitutionally permitted  to enact a  law providing  that certain of  the State's voters could vote  two,  five, or  ten  times  for  their legislative  representatives,  while  voters  living  elsewhere  could  vote only once. And  it  is  inconceivable  that a  state  law  to  the effect  that,  in counting  votes  for  legislators,  the  votes  of  citizens  in  one  part  of  the state would be multiplied by two, five, or ten, while the votes of persons in  another  area  would  be  counted  only  at  face  value,  could  be constitutionally  sustainable.  Of  course,  the  effect  of  state  legislative districting schemes which give  the same number of  representatives  to unequal  numbers  of  constituents  is  identical.  Overweighting  and overvaluation of  the votes of  those  living here has  the certain effect of dilution  and  undervaluation  of  the  votes  living  in  disfavored  areas  is easily demonstrable mathematically. Their vote  is simply not the same right  to vote as  that of  those  living  in a  favored pan of  the State. Two, five,  or  ten  of  them  must  vote  before  the  effect  of  their  voting  is equivalent  to  that  of  their  favored  neighbor.  Weighting  the  votes  of citizens differently, by any method or means, merely because of where they happen to reside, hardly seems justifiable. One must be ever aware

that  the  constitution  forbids  "sophisticated,  as well  as  simple‐minded, modes of discrimination." Lane v. Wilson, 307 U.S. 268, 275; Gomillion v. Lighfoot, 364 U.S. 339, 342. As we stated in Wesberry v. Sanders, supra.  We  do  not  believe  that  the  Framers  of  the  Constitution  intended  to permit  the  same  vote‐diluting  discrimination  to  be  accomplished through  the  device  of  districts  containing  widely  varied  numbers  of inhabitants.  To  say  that  a  vote  is  worth  more  in  one  district  than another  would...  run  counter  to  our  fundamental  ideas  of  democratic government …

Argued November 19, 1970 Decided June 7, 1971 

 In this decision the U.S. Supreme Court held that slightly larger deviations are tolerable/or local government apportionment schemes. 

  For  more  than  a  century  the  Rockland  County  board  of  supervisors consisted  of  the  supervisors  of  the  county's  five  towns,  resulting  in extensive  functional  interrelationships  and  intergovernmental coordination between county and towns. Severe malapportionment due to  population  growth  led  to  court  ordered  reapportionment.  The proposed  plan,  challenged  by  petitioners,  provides  for  a  county legislature  of  18  members  chosen  from  five  districts,  corresponding with the towns, each district being assigned legislators in the proportion of its population to that of the smallest town. The plan produces a total deviation  from  equality  of  11.9%.  The  Court  of  Appeals  of  New  York upheld  the  plan.  Held:  In  light  of  the  long  tradition  of  overlapping functions and dual personnel  in  the Rockland County government and the  fact  that  the  plan  does  not  contain  any  built‐in  bias  favoring particular  political  interests  or  geographic  areas,  the  plan  is  not violative  of  the Equal  Protection Clause.  Pp.  185‐187.  In  assessing  the constitutionality of various apportionment plans, we have observed that viable local governments may need considerable flexibility in municipal arrangements if they are to meet changing social needs, Sailors v. Board of  Education,  387  U.S.  105,  110‐111  (1967),  and  that  a  desire  to preserve  the  integrity  of  political  subdivisions  may  justify  an apportionment plan which departs from numerical equality. Reynolds v. Sims, supra, at 578. These observations, along with  the  facts  that  local legislative  bodies  frequently  have  fewer  representatives  than  do  their state and national counterparts and that some local legislative districts

may  have  much  smaller  population  than  do  congressional  and  state legislative  districts,  lend  support  to  the  argument  that  slightly  greater percentage  deviations  may  be  tolerable  for  local  government apportionment  schemes,  cf.  ibid.  Of  course,  this  Court  has  never suggested  that  certain  geographic  areas  or  political  interests  are entitled  to  disproportionate  representation.  Rather,  our  statements have reflected the view that  the particular circumstances and needs of local  community  as  a  whole  may  sometimes  justify  departures  from strict equality.   We  emphasize  that  our  decision  is  based  on  the  long  tradition  of overlapping  functions  and  dual  personnel  in  Rockland  County government and on the  fact  that  the plan before us does not contain a built‐in bias tending to favor particular political interests or geographic areas.  And  nothing  we  say  today  should  be  taken  to  imply  that  even these  factors  could  justify  substantially  greater  deviations  from population equality. But we are not prepared to hold that the Rockland County  reapportionment plan violates  the Constitution, and,  therefore, we affirm.

In this decision the U.S. Supreme Court found that five of the six contested districts discriminated against blacks by diluting the power of their collective vote. 

  The  North  Carolina  General  Assembly  passed  a  redistricting  plan  for  the  state's Senate and House of Representatives. Black citizens of North Carolina alleged that the  plan  created  seven  new  districts  where  blacks  would  not  be  able  to  elect representatives of their choosing. They filed suit in a District Court claiming that this violated Section 2 of the Voting Rights Act of 1965 and the Fourteenth and Fifteenth Amendments.  Before  the  District  Court  could  hear  the  case,  Congress  amended Section 2 of  the Voting Rights Act  in order  to clarify  that voting violations needed only  to  have  a  "discriminatory  effect"  and  required  no  "discriminatory  purpose." Considering  the  "totality  of  circumstances"  of  the  redistricting  plan,  the  District Court ruled that six of the new districts violated the newly amended Voting Rights Act  by  diluting  the  power  of  the  black  vote.  The North  Carolina Attorney General appealed the decision directly to the Supreme Court. 

Question: 

Did  the  District  Court  err  by  holding  that  a  North  Carolina  redistricting  plan unlawfully discriminated against blacks in six voting districts? 

Conclusion:  No.  The  Court  found  that  five  of  the  six  contested  districts  discriminated  against blacks by diluting  the power of  their  collective vote.  Justice William  J. Brennan  Jr. delivered the opinion for a unanimous court. The District Court properly performed its  function "to ascertain whether minority group members constitute a politically cohesive unit and to determine whether whites vote sufficiently as a bloc usually to defeat  the  minority's  preferred  candidate."  The  District  Court  correctly  analyzed data from three election cycles in North Carolina to determine that the black voters strongly  supported  black  candidates,  whereas  whites  usually  voted  against  black candidates. The redistricting plan apportioned "politically cohesive groups of black voters"  into  districts  where  blocs  of  white  voters  would  consistently  defeat  the black  candidates.  In  violation of  the Voting Rights Act,  this damaged  the ability of black citizens "to participate equally in the political process and to elect candidates of their choice."

GLOSSARY OF REDISTRICTING TERMS (Source: State of Maryland Redistricting Website) 

   Allowable Variance: Equals ±5% of the Ideal District Population.  At­large  Voting:  An  election  in  which  voters  elect  a  candidate  or candidates  from  an  entire  political  subdivision  as  opposed  to  a  single election district.   Compactness: Courts prefer districts in tight geometric shapes such as circles and squares. A traditional districting principle; the ideal being a district with every point along its boundary being of equal distance from its center. A circle is the most compact shape for a district. An easy way to  test a district  for compactness  is  to measure the maximum distance on a north/south, and east/west axis and divide the smaller result into the larger. Most geographers consider a ratio of more than three‐to‐one non‐compact.   Contiguity: Except for populated islands, districts must be in one solid piece of land; a district in multiple unconnected pieces is not allowed.   Electoral Districts: Geographical areas represented by elected political officials.   Existing Council Lines: It should be the goal of the mapmaker to move as few people as possible from their present districts in order to achieve the  desired  goal.  After  a  map  is  drawn,  the  population  of  all  the precincts  that  change  districts  should  be  totaled.  If  two  maps  of otherwise equal quality move different numbers of people, the one that moves the fewest people is desirable.   Gerrymandering:  The  practice  of  drawing  a  map  with  the  intent  of achieving  a  particular  political  result.  Usually  evidenced  by  strangely shaped districts. Named after Elbridge Gerry,  the 4th Vice President of the  United  States,  who  while  Governor  of  Massachusetts  in  1804, attempted to place all the Federalists voters of the state in one district. Critics said the district looked like a salamander.   Ideal District Population (also Mean District): The result achieved by dividing  the  total  population  of  the  jurisdiction  by  the  number  of

districts  to be  created  (e.g.  a  jurisdiction of 500,000 persons with  five (5) districts would have a ideal or mean district of 100,000 persons).    Largest District Allowed: Equals Ideal District Population plus Allowable Variance (+5%).   Majority­Minority  Districts:  A  legal  term  of  art  used  to  describe districts in which a racial or ethnic minority constitutes a majority of the population.   Mean Deviation:  This  measure  of  inequality  examines  the  degree  to which  the  populations  of  all  districts  in  a  redistricting  plan  vary  from the  ideal population of a district. The "absolute mean deviation"  is  the sum of the absolute deviations of all districts divided by the number of districts.  The  "mean  deviation  percentage  variance"  is  the  absolute mean  deviation  for  a  particular  redistricting  plan  divided  by  the  ideal population, expressed as a percentage. Thus, if the ideal population of a district  is  100,000  and  there  are  five  (5)  districts with  populations  of 102,000,  9,000,  101,000,  100,000,  and  99,000  respectively,  the "absolute  mean  deviation"  would  be  1,000  (the  sum  of  the  absolute deviations of the five (5) districts, which equals 5,000, divided by five) and the "mean deviation percentage variance" would be .01 or 1 percent for that redistricting plan (the absolute mean deviation of 1,000 divided by the ideal population of 100,000).   Minimum  and  Maximum  Districts  and  Deviations:  To  determine whether a plan complies with the 10% deviation rule:   

1) Determine how far each district varies from the mean.  2) Then add the deviations of the largest and smallest districts.  

 A  total  of  less  than  10% will  probably withstand  legal  challenge.  The easy way to avoid problems is to set maximums of 5% deviation for any district.  So  in  our  fictional  jurisdiction  of  500,000  person  and  five  (5) districts, the largest possible district would be 105,000 and the smallest possible district would be 95,000.   Minority Vote Dilution:  A  legal  term  of  art  specifically  referring  to  a claim under  Section 2  of  the Voting Rights Act  of  1965  alleging  that  a newly drawn district has been constructed  in a manner, which dilutes the voting strength of minorities.

 Multimember District: A district  that elects  two or more members of an elected body.   Natural  Boundaries:  If  possible,  it  is  desirable  that  districts  end  at physical divides like mountains and rivers, rather than in the middle of communities.   One  Person  One  Vote:  A  constitutional  standard  for  all  electoral districts established by the Supreme Court, which requires that districts be equal in population.   Population  Equality:  the  principle  that  districts  should  be  of approximately  the  same  population  size.  If  the  districts  were  not approximately  the  same  size,  the  votes  of  the  citizens  in  the  large districts would be diluted because  they have  to  share  their votes with many more people  than  the citizens of  the smaller districts. Generally, absent some unusual circumstances, courts have set a maximum limit of ten percent (10%) difference between the largest and smallest districts.   Preclearance: Refers to the procedure that jurisdictions under Section 5  of  the Voting Rights  Act  of  1965 must  go  through  in  order  to make changes  in voting procedures.  Jurisdictions  covered under  this  section must  "preclear"  new  redistricting  plans  with  the  U.S.  Department  of Justice or the U.S. District of Columbia.   Racial Block Voting: Evidence used in vote dilution cases, which show that voters in a particular district vote for candidates along racial lines.   Reapportionment: The allocation of seats  in a  legislative body among established  districts where  the  district  boundaries  do  not  change,  but the number of members per district does.   Redistricting:  The  drawing  of  new  political  boundaries;  usually  done following the decennial Census.   Retrogression: A legal term of art specifically referring to a claim under Section 5 of  the Voting Rights Act of 1965, which alleges  that  a newly drawn district has been constructed in a manner that worsens minority voting  strength  in  a  district  as  compared  to  the  previous  district configuration.

 Smallest District Allowed: Equals Ideal District Population minus Allowable Variance (‐5%).   The  Voting  Rights  Act  of  1965:  A  federal  statute  enacted  under authority of the 15th Amendment that invalidates state election laws and practices that disenfranchise voters on account of race or color.   Section  2  of  the  Voting Rights Act  of  1965:  Generally  outlaws  any voting qualification or practice that abridges the right of citizens to vote. This  section  is  the  basis  for  minority  vote  dilution  claims  against redistricting plans.   Section  5  of  the  Voting  Rights  Act  of  1965:  Section  of  the  Act requiring certain covered jurisdictions to submit any planned change in voting procedures  to  the U.S. Department of  Justice  for prior approval. State  and  congressional  redistricting  plans  are  considered  "changes" under this section.
