1. Chair's announcements

1.1 Interpretation

Interpretation is available in the following languages: DE, EN, FR.

1.2 Invitations to Commissioners Vice-President Dombrovskis and Commissioner Thyssen will participate in an

exchange of views in EMPL under the Structured Dialogue exercise on 2 May, from 15:00 to 17:00.

Vice-President Katainen will participate in an exchange of views in EMPL under the Structured Dialogue exercise on 30 May, from 9:00 to 10:30.

The drafting of the written EMPL contribution for the Structured Dialogue will commence as and when the CCC indicates the timetable and the number of priorities are expected from each committee.

1.3 Update on Brexit: On UK side:

The Upper House of the British Parliament (“Lords”) amended the Government’s Bill authorising it to send the Article 50 notification last week. This amendment sought to protect the rights of EU-27 citizens currently living in the UK following a UK withdrawal from the EU. A further amendment requiring the Government to obtain Parliament’s approval to leave the EU “without an agreement as to the applicable terms” (the so-called WTO-terms exit) appears [to have good chances of being approved] on Tuesday 7 March.Most commentators expect the Lower House (“Commons”) to reject the Lords’ amendment[s]. If this happens, the Lords appear to be unlikely to re-establish those amendments when the Bill returns from the Commons. The British Government’s apparent wish to make the Article 50 notification on or around 15 March (in advance of the announced deadline of the end of March) still appears realistic despite the adoption of at least one amendment by the Lords. On EP side:- Following the CCC meeting of 14 February, committees Chairs were informed on 15

February that, in view of the preparation of the EP resolution, which would be adopted as soon as possible after the triggering of Art. 50 TEU by the UK, Committees possible (short) input should be sent to the CCC Secretariat by Wednesday 1 March at noon.

- Against this background, the EMPL Secretariat prepared a draft contribution, which was circulated to the coordinators and Members of the Brexit Working Party on 21 February (deadline for comments: 27 February); the EMPL contribution was finalised between 28 February and 1st March and sent to CCC on 1st March (see Annex).

- Next steps:  the resolution, prepared by the CoP after consulting the CCC, and signed by as many group leaders as possible, and by the Chair of the AFCO committee, will be tabled directly to plenary (second half of March at an extra session). Hence, groups will have now further possibilities to contribute to this resolution.

2. Follow-up to previous Coordinators’ decisions

2.1 Follow-up to exchange of views on 5 December 2016 with Pedro Martins, member of the expert group on labour market and social reforms in Greece under the Memorandum of Understanding (MM)

The exchange of views was held with Mr Martins on 5 December 2016. The Memorandum of Understanding imposes labour market reforms.1 The expert group took a position on the proposed reforms.2 Ms Jongerius suggested during the exchange of views to question the ‘Troika/Institutions’ as to how it would take account of the recommendations of the experts.

Decision of 15 December

The Coordinators decided to invite those representatives of the European Commission who are responsible for

negotiations on Greek labour market reforms under the MoU a representative of the ILO a representative of the Council of Europe a representative of the Eurogroup

to an exchange of views at a future EMPL meeting.

Note: The Chair informed the secretariat after the meeting that two other Members of the expert group had approached him announcing that they would submit their position in writing in order to illustrate the views of the majority within that group.

Decision of 9 February

The Coordinators also decided to invite a representative of the Greek unions.

Update: The following representatives have been invited to a future EMPL meeting:

- EC: Mr Marco Buti, DG ECFIN, Director General, replaced by Mr Declan Costello, chief negotiator is available for an exchange of views; date and time to be agreed

- Eurogroup: Mr DijsselbloemHe rejected the invitation. After the Dutch elections and the ensuing potential

change in the Presidency of the Eurogroup, the President will be invited again.

2.2 Adapting a number of legal acts providing for the use of the regulatory procedure with scrutiny to Articles 290 and 291 of the Treaty on the Functioning of the EU (BM)

On 9 February Coordinators decided to deliver an opinion in the form of a letter (Rule 53(1)). Draft letter is under preparation and will be circulated to Coordinators for comments.

2.3 A. European services e-card and related administrative facilities

2016/0402(COD) COM(2016)0823 Responsible: IMCOThe secretariat was invited to submit additional information so as to assess whether a request for Rule 54 might be warranted, the decision to be taken at the next meeting (time permitting) or by a written procedure.Update: The secretariat maintains its assessment that Rule 54 is not warranted and that a request would have no chances to succeed.

A. Services e-card Regulation (COM(2016)824) [ALDE Rapporteur]

The proposal preserves the existing EU provisions on social issues, employment conditions (in particular posting of workers, workers' rights and the social pillar) or health and safety. The proposal does not change or put into question existing safeguards in this respect, see recitals 11, 12 and in particular Article 2, paragraph 3, which guarantees that in case of a conflict between this Regulation and another Union act “the provision of the other Union act shall prevail and shall apply...”. Article 2 paragraph 3 further specifies that “This Regulation, in particular its Chapter III, shall be without prejudice to the rights of workers, the obligations of service providers and related controls in Member States laid down in Directives 96/71 and 2014/67/EU.” Where Member States have set up procedures that allow for a declaration relating to the posting of workers pursuant to Article 9 of Directive 2014/67/EU to be completed by electronic means, the European services e-card shall direct the card holder to the relevant national procedures. Article 6 concerns formalities for seconded staff, Article 7 formalities for movement of self-employed. Posting is mentioned in Recital 27 and in Article 6(2) and (3).

This Regulation does not modify any substantive rules on cross-border service provision of services as laid down in the Services Directive, nor any rules related to posting of workers, health and safety or protection of the environment.

B. Services e-card framework Directive (COM(2016)823) [EPP rapporteur]The proposal does not change or put into question existing safeguards in this respect, see recitals 8, 9 and in particular Article 2, paragraph 3, which guarantees that in case of a conflict between this Directive and another Union act “the provision of the other Union act shall prevail and shall apply...”. Article 2 paragraph 3 further specifies that “This Directive shall be without prejudice to the rights of workers, the obligations of service providers and related controls in Member States laid down in Directives 96/71 and 2014/67/EU.” Recital 9 also clarifies that: “...this Directive does in no way affect the obligations service providers should respect in accordance with Directive 96/71/EC of the European Parliament and of the Council and Directive 2014/67/EU of the European Parliament and of the Council.”

Action proposed: To draw up both opinions according to the normal procedure (Rule 53).

3. Pending conflicts of competence

3.1. Request by EMPL to apply Rule 54 to the AFCO report on the implementation of the EU Fundamental Rights Charter (RS)

EMPL Coordinators, at their meeting of 15 December 2016, requested the application of Rule 54. Accordingly, the EMPL Chair, by letter of 16 January 2017 to the CCC Chair, requested the application of Rule 54. By letters of 10 January 2017 and 15 December 2016, the CCC Chair was informed by the Chairs of AFCO, PETI and LIBE that they agreed on a 53+arrangement (initially PETI and LIBE asked for the application of Rule 55). By letter of 8 February 2017, the AFCO Chair asked the CCC to help to find a similar 53+ arrangement with EMPL. According to information from the AFCO Secretariat of 1 March, this request is pending at CCC level.

3.2. Request by EMPL to apply Rule 54 to the JURI report regarding the Proposal for a Directive of the EP and of the Council on preventive restructuring frameworks, second chance and measures to increase the efficiency of restructuring, insolvency and discharge procedures and amending Directive 2012/30/EU (JuB)

The position of the EMPL coordinators of 15 December 2016, namely to apply rule 54 regarding the EMPL fields of responsibility, was communicated by letter of 31 January 2017 from the EMPL Chair to the CCC.

At its meeting on 1 February 2017, the CCC invited EMPL and JURI to find an agreement by 10 February 2017.

By letter of 9 February 2017 (letter included in the meeting documents), the JURI Chair opposes the EMPL request for rule 54.

5.1 Budgetary procedure 2018 (EC)

The budget procedure is traditionally subject to a specific procedure, with tight time constraints, in order to follow the steps in the lead committee.Coordinators are invited endorse the following procedure and timetable in relation to the procedure for Budget 2018.

See whole BUDG timetable in Annex.

5.1.1. Pilot projects/Preparatory actions proposals for 2018Once a year, normally May or early June, any Member, committee or group has the right to submit proposals for new pilot projects and preparatory actions or proposals for prolongation of existing ones for pre-assessment to the Commission1. The Commission then evaluates the implementability of all proposals- the result of this assessment is normally published early July.

Note: BUDG suggests to keep the number of proposals low (traditionally 2-3) which, with a higher financial envelope, should ensure efficacy and added value. The proposals should not replicate existing actions and be feasible.

Annex: list of PPs and PAs in the 2017 budget and 1st assessment report.

In the past, EMPL coordinators met in July and decided, on the basis of the Commission assessment, which PPs/PAs would be submitted to BUDG as EMPL AMs. In this respect, practices differ among Committees, lots of them putting all PPs/PAs proposed by their Members directly to the vote.The EMPL Secretariat therefore proposes that the coordinators decide:

5.2. Initial qualification and periodic training of drivers of certain road vehicles for the carriage of goods or passengers and driving licences (CF)EMPL/8/09187***I 2017/0015(COD) COM(2017)0047 – C8-0025/2017

Responsible: TRANObservation

Directive 2003/59/EC lays down the initial qualification and periodic training requirements for professional drivers of trucks and buses, thus improving safety on European roads.The purpose of the Directive is to raise standards among new drivers and to maintain and improve the professional skills of existing truck and bus drivers throughout the EU. The Directive aims specifically to increase drivers’ awareness of the risks, with a view to reducing risks and increasing road safety. Moreover, the Directive lays down standards on professional skills to ensure fair competition throughout the EU.

Action proposed:

No opinion and no action on the accompany impact assessment (SWD(2017)27) and summary (SWD(2017)26).

5.3. Amending Regulation (EU) No 182/2011 on rules and general principles concerning mechanisms for control by Member States of the Commission’s exercise of implementing powers (BM)

EMPL/8/09310***I 2017/0035(COD) COM(2017)0085Responsible: JURIObservation: The current proposal under the ordinary legislative procedure amends Regulation (EU) 182/2011 by modifying the procedures for the adoption of implementing acts at the level of the appeal committee. The overall objective of the regulation is to prevent Member States from issuing a “no opinion” in the appeal committee and contains four targeted amendments designed solely to “improve the functioning of the comitology procedures at the level of the appeal committee in order to ensure wider political accountability and ownership of politically sensitive implementing acts.” The Commission introduces four main elements which, if adopted, would change the current procedures, namely:• To remove abstaining Member States from the calculation of a qualified majority in the appeal committee. This proposal considers Member States which are either not present for a vote or which abstain as “non-participating member states.” Decisions of the appeal committee shall only be valid if at least 50 % of the Member States “participate” in the vote.• To strengthen the role of the appeal committee by allowing it to hold a repeat meeting at ministerial level if no agreement can be reached between the permanent representations of the Member States. • To allow the Commission to refer to the Council for its views on an issue in case a “no opinion” is expressed in the appeal committee. • To reveal the voting positions of Member States in the appeal committee to the public. The proposal does not include any aspect under the EMPL competence.

5.4. Progress report on the implementation of the European Disability Strategy (2010-2020)SWD(2017)29 (MM)This long-awaited report describes the implementation of the Disability Strategy so far and lists some of the main achievements in each of the areas. It also looks at the role of the supporting instruments and at the implementation of the UNCRPD within the EU institutions. Finally, it looks ahead at how the Strategy will continue to deliver on its objectives, taking into account the UN Concluding Observations.The Commission launched a public consultation  to collect views from a broad range of stakeholders on the current situation of persons with disabilities and the impact of the Strategy so far, gathering more than 1,500 contributions. The results of the public consultation clearly show that the situation of people with disabilities remains challenging in terms of participation in everyday activities, rights, employment, accessibility, discrimination and mobility within the EU. While most of the concrete concerns expressed by stakeholders relate to actions and/or competences of the Member States, the European Commission gleaned some invaluable input on the views of persons with disabilities (see Annex 1). In addition, the report includes a comprehensive and up-to-date overview of EU legal acts with an impact on disability matters (Annex 5). This list complements the initial EU Declaration of Competences.Coordinators' decision of 26 May 2016:In May 2016 EMPL Coordinators "decided that the implementation of the CRPD should be monitored in 2017 by means of a resolution based on an Oral Question, and in 2018 by means of an implementation report."Action proposed:-  Instruct the Chair to request an implementation report on the European Disability Strategy, replacing the oral question and resolution foreseen for 2017 on the implementation of the CRPD- appoint a rapporteur

6. European Solidarity Corps initiative - legal opinion, following the request for the application of Rule 54 between the JURI and EMPL Committees (PR)

Annex: request by the EMPL Chair, text of the legal opinion by the JurisconsultOn 7 December, European Commission Vice-President Kristalina Georgieva launched the European Solidarity Corps with the participation of Commissioners Marianne Thyssen, Christos Stylianides, and Tibor Navracsics.At their meeting of 15 December 2016, the Coordinators of the Employment Committee decided to request a legal opinion from Parliament’s Legal Service on the ESC initiative in order to obtain clarifications pertaining inter alia to• the legal basis of the Commission initiative• the legality of the potential use of existing EU funds (e.g. of the Employment and Social Innovation programme (EaSI), Erasmus+, etc) for the project in the light of the founding regulations of those funds and in the light of the annual EU budget.Coordinators can find the reply of the Legal service among the annexes.In its opinion, the Legal Service has reached the following conclusions:

"( a) the Communication launching the European Solidarity Corps is, for the time being, the only text concerning the establishment of the European Solidarity Corps. However, it is not a legally binding instrument and it does not produce any independent legal effects; consequently, the question of the appropriate legal basis for the European Solidarity Corps initiative simply does not arise at this juncture, since no new binding act (or proposal for such an act) concerning the European Solidarity Corps has been adopted yet;

(b) the content of the objectives pursued by the European Solidarity Corps initiative, as they are set out in the Communication, appears to fall within the scope of the objectives pursued by the Union in the fields of social policy and of education, vocational training and youth;

(c) recourse to the financial sources identified so far for the initial funding of the European

Solidarity Corps does not appear to raise legal concerns as to the fulfilment of their formal allocation requirements. A legal assessment of any other future funding arrangements will only be possible after these will be known in detail."

The Commission’s long-term planning foresees the adoption of the following initiatives on 24 May 2017:

Youth Initiative: modernising school and higher education; proposal for improved tracking of outcomes for graduates and also young people who have followed vocational education and training

Legal proposal consolidating the European Solidarity Corps

Action proposed: EMPL could decide to contribute to the drawing-up of an Oral Question + Resolution as envisaged by the CULT Committee. The arrangements of this cooperation could be negotiated by the secretariats acting under the political authority of their chairs.Note: Drawing up Oral Questions and Resolutions jointly by two committees is not foreseen by the Rules and requires good will and loyal cooperation on both sides.1 The tentative CULT timetable envisages to bring the matter to the plenary in good time before 24 May 2017.

7. EMPL hearings in the second half of 2017

1. Annual quota for hearings: 16 reimbursed experts.2. Requests for hearings during the 2nd half of 2017 must be submitted to CCC by 23 March 2017.It is recommended to limit the number of hearings in the 2nd half to two, one in October and one in November.Political groups were kindly asked to send their proposals for hearings for the 2nd half of 2017 by e-mail at the latest by 1 March 2017 COB to the secretariat.Background information: - Each committee may hear a maximum of 16 guests each year whose expenses will be covered. (EMPL might have used up to 8 experts in the in the 1st half of the year, as well as the 2 experts to be selected for the joint LIBE/EMPL/PETI hearing on EU nationals in the UK.- Hearings shall take place on Parliament's premises during the ordinary meeting time of the organising committee. - It is recommended to link hearings to ongoing legislative or non-legislative reports.The Secretariat has received suggestions for public hearings, which can be found summarised in a table, annexed to the notes.A list of hearings held since the beginning of the parliamentary term is also annexed to the notes.

I would very much appreciate your participation to organize this event.

The hearing could take place once the UK has triggered the Article 50 procedure, in the period April-June 2017.

On 17.02, the Secretariat has received a request by EUROFOUND to present some mid-term findings of our EP pilot project on “The Future of Manufacturing in Europe” at a joint EMPL – ITRE committee meeting. A possible day could be 6 November 2017 as both EMPL and ITRE have committee meetings on that day. The subject and modules can be of interest for MEPs of both committees.For your information: The Future of Manufacturing in Europe is a Pilot Project proposed by the European Parliament (initiated by MEP Teresa Riera (former S&D ITRE coordinator)) in 2013 (for DBudget 2014) and continuation in 2014 (for DBudget 2015) and delegated to Eurofound by the European Commission (DG GROW). The project commenced in April 2015.Context: on 16th February, 92 EU manufacturing industry associations have signed a Joint Declaration for an ambitious EU industrial strategy. In this declaration, they remind Mr. Juncker that at the beginning of his mandate, he identified the reindustrialisation of Europe as one of his top priorities and confirmed the objective of increasing the share of industry in the European GDP to 20% by 2020. They see that in the preparation of the next MFF, it is vital for the EC to act and help the EU remain a competitive global industrial power playing in a fairer world market. They remind that the MSs (European Council) and the EP clearly stated their full support for a strong European industrial strategy via the European Council Conclusions calling to strengthen and modernise the EU’s industrial base (15 December 2016) and the EP Resolution on the need for a European reindustrialisation policy (5 October 2016).Action proposed: Floor to the Coordinators to discuss a potential organisation of a joint EMPL-ITRE meeting.

Estonia, during the May turquoise week. On 16 January 2017, the Bureau confirmed this authorisation.The main purpose of the delegation visit is to study the employment and social effects of a highly advanced digital economy and to establish contacts with social partners and other stakeholders on the establishment of a European Pillar of Social Rights and the most recent developments regarding the free movement of persons in the EU, including posting of workers and the issue of the so-called brain-drain. Also, the functioning of the ESF and YEI will be inspected.
